Queensland Covid-19 Applicable Event
A six month extension to development approval and compliance permit currency periods and periods for completion has been declared by the Deputy Premier and Minister for State Development, Infrastructure, Local Government and Planning, the Hon. Steven Miles MOP, on 1 September 2021. Under section 275R of the Planning Act 2016, the Minister has the power to declare an extension to a period under the Planning Act for an applicable event.
This means that a development approval in effect at the time the extension notice is given, or which comes into effect until 30 September 20201 will have an additional six months to to undertake the approved development. Approvals for building work under section 71 of the Building Act 1975 (ie. relating to demolition, removal and rebuilding) do not benefit from this extension.

The Planning Minister has powers to declare an applicable event. The concept of the ‘applicable event’ ensures that the state government is able to make advance preparations or respond to emerging circumstances that affect a State interest under the Planning Act.
