Hi Everyone

Along time between drinks. A bit of recap of where we are at...

I remain opposed to the 7/11 development next door to me, mainly on the grounds of its proven health concerns in regards to unchecked fuel emissions entering the immediate local residential area. This is still allowed to occur in this country despite legislation in the US and other jurisdictions banning the building of new petrol stations within 300 metres of housing, hospitals, churches etc. I also remain concerned about yet another multinational taking more business away from a small town that is already doing it hard.

Anyway VCAT, in its wisdom, has vetoed the HRCC, and much of the Horsham Community, who were opposed to this development ... so that's the end of that.

My intention now with this page is to keep my neighbors and the community updated with this development as it proceeds.

I spoke to the Baker Group project managers who informed me that work on the site will commence in the next couple of weeks. They said that they would be working 7-5 most weekdays (not sure if that includes weekends).

The actual demolition of the existing Mobile Aids Site will take about a week. I'm guessing that's where they'll start. I know my neighbour Ron behind me was approached by the project managers but I'm not sure who else in the surrounding area was informed.

Well, VCAT has made the decision that the Servo will go ahead. Obviously I, as many of you out there, will be gutted by this outcome. But we all did our best and that's all you can do.

The main takeaways for me from this long journey are:

(1) The law cannot protect my family.

(2) It does not matter what you can prove scientifically, its what you can get away with legally.

(3) There are still good people out there who are prepared to stand up for their communities.

I'd like to acknowledge all of you who have tried to fight this thing, in particular Di Bell who has given me so much personal support, as well as doing a stunning job standing up for the real people in Horsham, particularly at the VCAT Tribunal. You're a star Di!

Hi Everyone

This is the latest update from Di Bell after the final day at VCAT Tribunal...

Well, we’ve done what we can and now it’s wait and see. Points below are a short summary of the week for you:

1. VCAT tribunal hearing finished early – only went for 2.5 days

2. Spectrum and Council presented their submissions and then we presented ours.

3. The Expert Witnesses that had been appointed by Spectrum presented their reports.

4. Council and Objectors representative were able to cross examine the Expert witnesses.

5. The Member who chaired and conducted the tribunal clearly stated he has not made a decision and we won’t have a decision for about 4 weeks. He will make a decision whether the permit is to be granted or not, and what/if any, conditions would apply.

Thanks so much to everyone who gathered data, pictures etc, who took the time to submit statements of grounds for the hearing, and provided input for the final submission.

Special thanks to Chris for all the admin support, and to Tami for taking leave to support and assist me at VCAT, and to Harvey and Rae for attending the hearing in the gallery.

Finally, I would also like to express sincere gratitude to all who donated towards the costs following Tami’s call out for assistance. Your generosity has covered all our expenses to prepare and attend the Tribunal in Melbourne, as well as other associated costs along the way.

I continue to be very proud and grateful to be a part of such a wonderful community.

Hi Everyone,

The VCAT Tribunal Hearings have commenced this week in Melbourne. Here is a short update to let you know how things are progressing.

Yesterday Di did an amazing job presenting everyone’s submission to VCAT whilst being assisted by Tami.

HRCC also presented their submission to VCAT.

Today Spectrum Retail Group will present their submission to VCAT along with their expert witnesses.

There will be an opportunity for Di and the HRCC representative to ask Spectrum questions relating to their submission and expert witness reports.

Many thanks to Di and Tami for all their hard work representing us and Harvey & Rae being able to provide support with their visit to VCAT. Thanks to Christine for providing this information.

Hi Everyone

We recently received correspondence from the Council informing us that my property on 6 Doon Rd has been identified as part of a Contributory Heritage place.

This is in recognition of the cultural heritage significance of this precinct on Dooen Rd since it has, “local historical, representative and aesthetic significance to Horsham Rural City.”

Effectively this Heritage Overlay requires the HRCC to, “conserve heritage places and to ensure that ANY development does not adversely affect the significance of a heritage place.”

The Council further recognizes that, “Heritage places enrich peoples’ lives, often providing a deep and inspirational sense of connection to their community. They are a historical record telling us about who we are and the past that shaped us.”

WE DO NOT BELIEVE ANOTHER PETROL STATION IN THIS IMPORTANT HERITAGE PRECINCT IS IN KEEPING WITH WHAT THE REAL HORSHAM COMMUNITY WANTS! DO WE REALLY WANT THIS TO BE THE LEGACY WE LEAVE BEHIND FOR OUR FUTURE GENERATIONS?

Things may have been quiet on the social media front, but we can assure you that behind-the-scenes people are working very hard in preparation for the upcoming VCAT proceedings scheduled for October 9th to 13th in Melbourne.
Di Bell will be representing the group of objectors and presenting submissions on behalf of 2 additional parties.
Ms Bell and I will be required to stay in Melbourne for the duration of the proceedings.

During this entire process several individuals have made offers of monetary assistance to offset the large personal financial outlay required. It is now time for those who can contribute to offset the $1900 travel and accommodation costs.

Hi Everyone

Well, we had a marathon session online today completing the VCAT compulsory conference. I believe we acquitted ourselves but unfortunately we did not come to any agreement. Therefore we are off to King St in October to present to the VCAT Tribunal Hearing.

The Final Round is coming up Horsham and we need all moral support you can muster. Stay Tuned...

We been a bit quiet lately but the wheels are certainly still ticking over behind the scenes as we get ready for the Compulsory Conference at VCAT in Melbourne.

This is basically where objectors who have continued with this process (including the council) are heading down to King St in Melbourne to put forward our case against this development to VCAT.

This will all be happening on the 13th of July. If an agreement isn't reached at this conference, it will go to a tribunal hearing sometime in October.

With council elections coming up, this will be a litmus test of sorts to see if our Mayor: Robyn Gulline and the Council will stand by their brave decision to oppose this appalling development, and provide the necessary data, resources and manpower to defend the position they have taken.

For they represent this community, and the community has spoken LOW AND CLEAR on this matter.

MAKE A DIFFERENCE HRCC. STAND BY YOUR OWN PLANNING SCHEME. STAND BY THE PEOPLE WHO VOTED YOU IN!
