I came across this on Facebook and it caught my attention...

First and foremost, it’s important to note that the property market in Botswana is an open market. This means tenants and landlords can agree on the terms and conditions of the rental agreement without the intervention of any regulatory body. Your rental agreement with your landlord could be either oral or written.

What is Eviction?

Let’s define “eviction” as a legal process by which a landlord can remove a tenant from a leased property. This brings me to a concept I’ve recently learned: “self-help eviction,” which occurs when a landlord illegally removes a tenant from a property without following lawful procedures.

What Does Self-Help Eviction Look Like?

Self-help eviction can take several forms, including:

- Making the tenant’s stay uncomfortable to force them to leave.
- Restricting basic utilities such as water, electricity, and other essential services.
- Locking the tenant out of the property and forcefully removing their personal belongings.
- Physically removing the tenant from the property.

Even if the tenant has breached the terms of the rental agreement, such as failing to pay rent, the landlord is still required to follow legal procedures for eviction. A landlord cannot simply take matters into their own hands. Although the process can be inconvenient for landlords, it is the legal standard that must be adhered to.

Lease Expiry and Tenant Rights

If the landlord and tenant agreed on a fixed lease duration and the lease has expired, the landlord does not need to serve an eviction notice or seek external permission to remove the tenant. In such cases, the tenant no longer has any legal rights to the property, unless if the tenant becomes unreasonable then i reckon its in the landlords best interest to take the matter to authorities.

In many cases, tenants in Botswana will vacate the property without causing issues for the landlord. could this be because we are a peace-loving nation or perhaps because many tenants are unaware that there is a proper legal process that should be followed in the event of an eviction?

Formula:
Gross Rental Yield % =
(annual rental income ÷ Purchase Price) x 100

Steps:
1. Annual Rental Income: Calculate the total rental income you expect to receive in a year.
2. Purchase Price: This includes the cost of purchasing the property, excluding any additional expenses.

Example:
- Annual Rental Income: P 120,000 (P 10,000 per month)
- Purchase Price: P 1,500,000

Gross rental income % =

( P120 000 ÷ P 1 500 00) x 100= 8%
( remember, a good yield is 5% to 10%)

2. Net Rental Yield
Net rental yield accounts for the expenses related to the property, providing a more accurate measure of profitability.

Formula:

Net rental yield% =
(( net rental income-annual expenses ) ÷ Purchase Price) X 100

Steps:
1. Annual Expenses: Include costs such as property management fees, maintenance, insurance, taxes, and any other recurring costs.
2. Subtract Annual Expenses from Annual Rental Income

3. Divide by Purchase Price
4. Multiply by 100 to get the percentage.

Example:
- Annual Rental Income: P 120,000
