Most landlords know they can serve notice - but few
know which one to use, when to use it, and what can make it invalid before it even lands on the doormat.

Getting this wrong doesn’t just delay the process. It can mean starting from scratch, losing months of time, and in some cases - losing the case entirely.

So here’s what you need to know. 👇

No Fault Possession Notice is used when you simply want your property back. You don’t need a reason - but you must give at least 6 months’ notice. It also comes with strict rules around deposit protection, correct forms, and timing.

Miss any one of them and the notice is void.

Breach of Contract Notice is used when a contract holder has breached their occupation contract - most commonly rent arrears, anti-social behaviour, or damage to the property.

This route often ends up in court, so your evidence and paperwork need to be watertight.

This is Wales-specific. Since the Renting Homes (Wales) Act came into force in December 2022, the old Section 21 and Section 8 notices no longer apply here.

If you’re still thinking in those terms - it’s time to get up to speed.

Most accidental landlords are breaking the law without knowing it.

You didn’t plan this. Maybe you inherited a property, moved in with a partner, or relocated and just never got round to selling. But here you are - a landlord.

And the law doesn’t care how you got there.

Here’s what you’re legally required to have in place:
✔️Gas Safety Certificate - renewed every year. Let it lapse and you lose the right to serve notice on your tenant.
✔️EICR (Electrical Inspection) - every 5 years. No certificate, no legal let.
✔️EPC rated E or above - required before a tenancy even starts.
✔️Deposit protection - must be registered within 30 days of receiving it, or you’re exposed to a claim worth up to 3x the deposit.
✔️Right to Rent checks - a legal requirement before any tenant moves in.

Most accidental landlords aren’t doing anything wrong on purpose. They just never had anyone walk them through it.

You have 48 hours to read a document that controls the next 12 months of your life. Most people spend 4 minutes on it.

Here are 5 clauses that can seriously catch you out 👇

1. Break Clause
Your exit door mid-tenancy. Without one, you’re legally bound to pay rent for the full fixed term - even if your circumstances change completely.

2. Rent Increase Terms
Your landlord can’t raise rent on a whim, but your agreement may give them more flexibility than you realise. Check how much notice they must give and whether increases are capped.

3. Deposit Deductions
Vague terms like “left in good condition” are open to interpretation - and rarely in your favour. Always request an itemised inventory on move-in day.

4. Maintenance Responsibilities
Landlords are legally responsible for heating, plumbing and structure - but some agreements make tenants liable for minor repairs. Know where that line is.

5. Notice Periods
Yours and your landlord’s are not always equal. Missing your notice window by even a day can lock you into another month of rent.

Read it. Ask questions. Don’t sign until you’re sure. 🖊️
