Did you know that new Fire Safety Regulations came into effect from 23rd January 2023, that require specific actions of the "Responsible Persons" of all multi-occupied residential buildings?

Leaseholders
If you are living in or letting out a leasehold property that is located in a multi-occupied building, and you have not yet been contacted by your Freeholder or their Managing Agents regarding the new regulations, you may wish to follow up with them as soon as possible to confirm the following:
(1) who is legally deemed to be the "Responsible Person" as dictated by The Fire Safety (England) Regulations 2022
and
(2) that the necessary actions required by the new regulations have been completed.

You should also bear in mind that even if you are not legally deemed to be a "Responsible Person", you may well be deemed a "Duty Holder" as described in The Fire Safety Order 2005, and therefore also have some responsibilities for fire safety.

Freeholders
If you are the Freeholder of a multi-occupied residential building, you are likely to be deemed a "Responsible Person" and should ensure that the actions required by the new regulations are taken as soon as possible, either by yourself or by someone else on your behalf.

🏡 Did you know that Property Licences are not just for HMOs???

Some Boroughs in England require landlords of properties rented to just one or two tenants, or to a family, to have a Selective Licence in place.

Failure to have the required Licence can prevent a landlord from serving a Section 21 Notice.

More importantly, it can result in enforcement action by the local authority, either by instigation of criminal prosecution proceedings or a hefty fine of up to £30,000 for each offence against each person responsible for letting an unlicensed property.

An application for a Rent Repayment Order (RPO) may also be made, which can result in the landlord being required to refund up to 12 months rental income from the property.

If in doubt, you can check the local authority website for the area where your rental property is located, or alternatively contact me for some free advice.
