The 2014 has received Royal Assent and is now law. and their must now check the Immigration status of their tenants or risk a fine.

The Immigration Act 2014 directs that private landlords or their agents ensure that their tenants have the right to be in the UK for the duration of their tenancy. Immigration Officials will now be able to serve a notice of potential liability on every landlord or agent following a visit to a private address that results in the identification of anybody found not to have permission to be in the UK. It will then be up to the landlord or agent to show that they made the necessary checks prior to signing their tenancy agreement or face a fine of up to £3000.
The implications of this law are wide. Not only will landlords and agents need to record the immigration status of their tenants at the start of a tenancy they will also have to ensure that no tenancy is granted for longer than somebody's permission to remain in the UK. Otherwise they risk finding themselves bound to a tenancy agreement that effectively becomes unlawful once the tenant's right to be in the UK expires.

Agent jailed and banned from being a director

A crooked managing agent has been jailed for four years and banned from being a company director for seven.

Mark Postle-Hacon, 41, ran PHC Management in Plymouth, and stole over £360,000 to fund his lifestyle and prop up his business.

He switched residents’ money which should have been used to pay utility bills, insurance, gardening and cleaning, into his own bank accounts, and faked documents to cover his tracks.

In court, he admitted defrauding residents and developers, and fraudulent trading.

His firm managed at least nine apartment blocks.

The alarm was raised by the company which owned one development and which noticed that invoices for which money had been handed over were unpaid.

The prosecution said Postle-Hacon gave repeated excuses and faked a bank statement, insisting there were funds in the management account.

The total lost in the frauds was £360,492, but investigators could not find any assets, and Judge Graham Cottle was forced to order a token £50 to be confiscated.

The court heard that Postle-Hacon, known locally as a socialite, had lost his home and marriage.

Simon Ralph, defending, described him as a “fundamentally honest man who has made a colossal error”. He said that Postle-Hacon was of previous good character and had an offer of a job if spared jail.

However, the judge at Plymouth Crown Court said he was evasive and dishonest.

He told Postle-Hacon: “There is a significant element of dishonesty and personal gain in your actions over a sustained period, causing considerable losses to a large number of individuals and there are no means whatsoever or making good those losses.”

Tough new laws designed to protect the public from aggressive are being implemented by Government

As part of the measures, bailiffs will be banned from entering homes at night or when only children are present. They also include safeguards preventing bailiffs from taking basic household items.

Justice Minister Helen Grant said today:

‘There are some very good, reputable bailiffs around, but we know there is bad practice out there that needs to be dealt with.

‘For too long bailiffs have gone unregulated, allowing a small minority to give the industry a bad name.

‘These laws will help to clean up the industry and ensure bailiffs play by the rules. They will also make sure businesses and public bodies can collect their debts fairly.’

The Government has taken action following a consultation last year on aggressive bailiffs. The measures laid in Parliament today are part of a wider package of reforms which will implement Part 3 of the Tribunals, Courts & Enforcement Act 2007. The changes will take effect in April 2014. The new measures will:

Stop bailiffs entering homes when only children are present.
Ban bailiffs from visiting debtors at night – they will only be allowed to enter between 6am and 9pm.
Ban from using bailiffs to seize property for residential rent arrears without going to court.
Prevent bailiffs from taking household items, such as a cooker, microwave, refrigerator or washing machine, because they are deemed to be reasonably required to satisfy the basic domestic needs of the debtor.
Ensure a notice period of seven days is given to the debtor before bailiffs take control of the debtor’s goods.
Ban bailiffs from selling goods removed from a debtor, unless seven days have passed from the date the goods were removed.
Make bailiffs responsible for proving to a court that there are, or likely to be, goods of the debtor on the premises before being granted the power to use reasonable force to gain entry. Before a warrant is granted, bailiffs must give the court information on the likely means of entry, the amount of force required and how the premises will be left in a secure state afterwards.
Last year, the Government updated the National Standards for Enforcement Agents and guidance for people in debt on Gov.uk which served as a reminder to bailiffs and creditors of their responsibilities. These changes will protect people in debt from rogue bailiffs and ensure creditors have a better understanding and more confidence in the process being carried out on their behalf.
