Do garden fences affect daylight and sunlight assessments?

It’s a question we are often asked when reviewing residential developments and house extensions.

Under BRE daylight and sunlight guidance, not everything that casts a shadow needs to be included in an assessment. The focus is usually on structures that produce consistent, measurable shading.

For example:

• Opaque fences or walls above around 1.5m may need to be considered when assessing sunlight to gardens.
• Lower fences, railings or trellises that allow light through are often treated differently.

Small details, such as boundary structures, can sometimes influence how sunlight reaches gardens and outdoor spaces - which is why they are sometimes reviewed during planning assessments.

Daylight & sunlight assessments and Rights of Light are often assumed to be the same thing, but they serve different purposes.

Daylight and sunlight studies are typically carried out as part of the planning process, helping to understand how a proposal may affect neighbouring windows and outdoor spaces.

Rights of Light, however, is a common law matter concerning whether a development interferes with a neighbour’s established access to light through their windows.

Because they measure light differently and operate in different contexts, a scheme that performs well in daylight in planning terms may still require separate Rights of Light consideration.

Understanding both early in the design process can help avoid delays, redesign and neighbour disputes later on.
