From 6 April 2027, most unused pension funds and pension death benefits will be brought into a person's estate for Inheritance Tax purposes.

HMRC has now published further details on how the new system will actually work.

โ€ข Value the entire estate i.e. every account, property, pension, policy and possession
โ€ข Complete the inheritance tax return, and in many cases pay the tax before they can access the money to pay it with
โ€ข Apply for the grant of probate
โ€ข Chase institutions that take weeks to reply
โ€ข Settle debts, sell property, distribute correctly
โ€ข Carry personal liability if they get it wrong

A will is only worth something if it's valid.

The five most common ways a homemade will fails:

Witnessing. Two witnesses, both present, neither of them nor their spouse a beneficiary. Get this wrong and your beneficiary loses their gift entirely.
Vague wording. "My savings to be split fairly" is not an instruction. It's an invitation to litigate.
No residuary clause. You've listed specific gifts but said nothing about what's left over. Whatever remains falls back to intestacy.
Never signed. Downloaded, drafted, filed in a drawer. Legally worthless.
Never updated. In England and Wales, marriage generally revokes an existing will.

Under the intestacy rules in England and Wales, an unmarried partner has no automatic entitlement. None. It doesn't matter if you've been together thirty years, share a mortgage, and raised children together.

The estate passes down a fixed statutory ladder. Spouse, then children, then parents, then siblings.

Your partner isn't on it.

Their option at that point is a claim under the Inheritance (Provision for Family and Dependants) Act 1975. A court process, at their expense, while grieving.

Most people spend more on a weekend away than they spend protecting everything they own.

Putting a will in place takes around 15 minutes of your time.
Now compare that to what happens without one.

Probate typically takes 9 to 12 months. If the estate is contested, 18 to 24 months. Legal and administrative fees commonly run between 1% and 5% of the total estate value.

On a ยฃ600,000 estate, thatโ€™s up to ยฃ30,000. Gone, before anyone inherits a penny.

A Family Business Trust is a type of trust established for the purpose of holding and managing a family-owned business. This type of trust is typically used in estate planning to help ensure the smooth transfer of a business from one generation to the next, and to minimise any potential inheritance tax liabilities.
The Family Business Trust is established outside of the will, but is usually referenced in the will. The Business Clause in the will would make a specific reference to business assets that meet HMRCโ€™s Business Property Relief (BPR) criteria.
One advantage of using a Family Business Trust is that it can help to protect the business from potential claims by creditors, as well as from any disputes that may arise between family members. By placing the business assets into a trust, the trustees are responsible for managing the business and making decisions on behalf of the beneficiaries.
Multiple Family Business Trusts may be required to be the most tax efficient, and each Trust would want to receive less than the IHT Nil Rate Band. This is because trusts that receive assets over the IHT Nil Rate Band are subject to inheritance tax at a rate of 20%, and the trust may also be subject to ongoing tax liabilities. Therefore, it is important to structure the trust in a way that minimises tax liabilities while still achieving the desired estate planning goals.
