The Renters Rights Act came into effect on 1st May 2026.
What are the major changes ?
1. Ban on section 2 "No Fault " Evictions.
Landlords can use a section 8 notice if they or their family are moving into the property, selling it or doing redevelopment.They can also evict tenants for failing to pay rent or anti social behaviour but via the courts. They can apply for a mandatory possession order only if tenants owe at least three months rent and have paid off nothing by the hearing date, or if the antisocial behaviour is deemed severe.
2. Move to Rolling Contracts.
All fixed term tenancies will move to rolling contracts, so the tenant can move out any time, by giving two months notice.
3. Advance Rent.
Landlords can ask a maximum of one month's rent in advance only after tenants have signed the tenancy agreement.
3. Restriction on Rent Increases.
A Landlord may only raise the rent once a year and it must reflect market rates. This can be challenged by tenants.
4.No More Discrimination.
Landlords cannot unreasonably refuse pets, Discrimination against tenants on benefits or with children is illegal.
5. No more bidding wars.
Landlords can no longer accept more rent than advertised.
6.Bigger Landlord Fines.
Up to £7,000 for minor breaches such as accepting rent higher than the advertised price, and up to £40,000 for serious breaches such as discrimination or evicting a tenant because you say you want to move back in but then immediately re-let the property.
7.The Landlord Ombudsman.
From an expected date of 2028, every landlord will have to sign up to a new database that will give tenants access to impartial and binding resolution for complaints.
8. Decent Homes Standard.
From an expected date of 2035, this new standard will require homes to be free from hazards such as severe damp and faulty boilers.
IF A LANDLORD WANTS TO SELL...or move into their rented property , four months notice is required and once possession is regained, THE PROPERTY CANNOT BE RELET for 12 MONTHS !
The reality of these changes is many landlords are leaving the sector.
A Landlord who takes on a 25 year Buy to Let mortgage can no longer secure rent for a guaranteed period of time giving them a measure of security .
