6 सबसे जरूरी बातें
1. किसी फ्लैट में निवेश करने से पहले यह देख लें कि जिस जमीन पर सोसायटी बन रही है, वह जमीन लीज होल्ड (सिर्फ पावर ऑफ अटॉर्नी) वाली है या फिर सेल डीड (रजिस्ट्री) वाली। अगर लीज होल्ड वाली है तो लीज कितने बरसों के लिए दी गई है। अगर 10 बरसों के लिए है तो यह भी मुमकिन है कि बिल्डर घर बनाकर चला जाए और बाद में लीज बढ़वाने का खर्च खरीदार पर आ जाए। साथ ही, इसके बदले में जो चार्ज संबंधित अथॉरिटी ने लगाया था, बिल्डर ने वह चुकाया है या नहीं। अगर बिल्डर ने वह नहीं चुकाया है तो बिल्डिंग को सील भी किया जा सकती है।

2. बिल्डर को संबंधित अथॉरिटी ने OC (ऑक्यूपेशनल सर्टिफिकेट) या POC (पार्शल ऑक्यूपेशन सर्टिफिकेट) दिया गया है या नहीं। अगर बिल्डर को यह सर्टिफिकेट नहीं मिला है और सोसायटी में गलत तरीके से बिजली आदि का कनेक्शन जोड़ा गया है तो भविष्य में उस कनेक्शन को बंद भी किया जा सकता है।

3. अगर किसी ने ऐसे डिवेलपर्स के पास निवेश किया है जो रेरा के तहत रजिस्टर्ड नहीं है तो यह खरीदार के ही रिस्क पर है। ऐसे बिल्डर ने अगर फ्लैट समय पर नहीं दिया या ले-आउट बदल दिया तो उसके खिलाफ कानूनी लड़ाई करना बहुत मुश्किल हो जाएगा।

4. लाल डोरा इलाके में अमूमन एक फ्लोर के लिए एक फ्लैट और कुछ तय मंजिल तक ही बनाने का अधिकार होता है। लेकिन बिल्डर इसमें फेरबदल कर देता है। एक ही फ्लोर पर कई फ्लैट बनाकर बेच देता है। कभी-कभी एक ही फ्लैट दो लोगों को बेच दिया जाता है। चूंकि इसकी रजिस्ट्री नहीं होती सिर्फ पावर ऑफ अटॉर्नी ट्रांसफर होती है इसलिए सरकार के पास भी इसका कोई सबूत नहीं होता। इन क्षेत्रों में एक परेशानी यह भी होती है कि अगर कॉलोनी अथॉराइज्ड नहीं है तो अमूमन नगर निगम के अंदर नहीं आता, इसलिए पानी, सीवर आदि की सुविधाएं भी जल्दी नहीं मिलती।

5. अगर कोई प्लॉट सरकार बेच रही है या कोई प्राइवेट बिल्डर बेच रहा है और उस प्लॉट पर रेरा का नंबर मिला हुआ है तो उसमें फंसने की गुंजाइश न के बराबर है। सरकार जब भी प्लॉट काटकर बेचती है तो उसमें सभी शर्तें पहले ही लिखी होती हैं। इसके लिए रेवेन्यू सरकार को जाता है। सरकार इसका रेकॉर्ड रखती है। अमूमन हर राज्य में पटवारी या उसका समकक्ष कर्मी हर 6 साल पर जमीन का निरीक्षण करता है और उसके मालिक का निर्धारण करता है।

6. पावर ऑफ अटॉर्नी कभी भी कोर्ट में एक सशक्त सबूत नहीं होता। अगर किसी के घर में बिजली कनेक्शन हो या कोई दूसरे सबूत ही क्यों न हो जमीन पर मालिकाना हक के लिए काफी नहीं हैं।

ऐसे होती है रजिस्ट्री
- स्टांप पेपर सारा विवरण टाइप होने के बाद ऐडवाकेट सेलर और बायर को रजिस्ट्री के लिए बुलाता है। सब-रजिस्टार के ऑफिस में सेलर, बायर और 2 गवाहों को जाना होता है।
- सभी के पास उसका आधार कार्ड होने चाहिए। अगर वोटर कार्ड है तो वह भी रख सकते हैं।
-सेलर और बायर को साथ में पैन कार्ड भी रखना पड़ता है।
-इनके अलावा जो सेलर है, उसे जमीन से जुड़े तमाम कागजात भी साथ में रखने होते हैं:
-अगर प्रॉपर्टी की रजिस्ट्री होनी है तो पुरानी सभी सेलडीड यानी रजिस्ट्री के कागज, पुराने प्रॉपर्टी टैक्स की रसीद आदि।
-जब सभी पेपर आ जाते हैं और सेलर को उसकी कीमत मिल जाती है, तब सब-रजिस्टार के सामने ही दोनों पक्ष साइन करते हैं और सभी पक्षों के फिंगर प्रिंट्स लिए जाते हैं। इनके फोटो भी होते हैं ताकि फ्रॉड की गुंजाइश न रहे। रजिस्ट्री के बाद कॉरपोरेशन के दफ्तर में म्यूटेशन जरूर कराएं।
