FREEHOLD VS LEASEHOLD.

Freehold and leasehold interests are two major types of ownership in landed properties.
They define the extent of rights a person has over a property and how long those rights last.

Freehold interest refers to full ownership of a property for an unlimited period of time. The owner has complete control over the land and any buildings on it, subject only to government regulations. This means the owner can use, sell, transfer, or pass the property to heirs without any time restriction.
Freehold ownership is often seen as the most secure form of property interest because it does not expire.

Leasehold interest, on the other hand, is a temporary right to use and occupy land for a fixed period, as agreed in a lease contract.
The land remains owned by another party known as the landlord or lessor, while the person using it is the tenant or lessee. Lease periods can range from a few years to several decades. Once the lease expires, ownership of the property returns to the landlord unless the lease is renewed.

So freehold gives permanent ownership and full rights over land, while leasehold provides limited rights for a specific period under agreed conditions

MARKETING MAP VS MUTATION:

When buying land, you will likely be shown two different drawings. They may look similar at first glance but they serve completely different purposes in your due diligence process.

Understanding this difference can protect you from costly mistakes.
1️⃣ The Site Map; This is a marketing tool. Its purpose is to give you a visual overview of the project and show what is available.
What it shows: Plot labels (A, B, C…), general layout and orientation, roads and entrances and availability (often coloured: green = sold, white = available).

What it lacks: exact technical measurements, beacon coordinates and legal survey details.

The Goal: To help you choose a plot based on position, near the entrance, corner plot, touching the road, etc. It helps you decide what you like. It does not legally define what you own.

2️⃣ The Survey / Mutation Plan.
This is a legal document, prepared and signed by a licensed surveyor and submitted to the Land Registry.

What it shows: Exact boundary measurements, total acreage or square meters, plot numbers tied to official records, beacon positions (the physical boundary markers on the ground)

The Goal: To legally define your property boundaries. This is the document used to generate your individual Title Deed.

Never buy land based on the Site Map alone, always request and verify the official Survey/Mutation Plan and check the beacons.

Before making payment: visit the site with the survey plan, confirm that the physical beacons on the ground match the measurements on the document and if necessary, involve an independent surveyor.

Buying Agricultural Land? Don’t Skip This Document! 🇰🇪

If you’re eye-ing that perfect shamba for farming or investment, there is one document that stands between you and legal ownership: The Land Control Board (LCB) Consent (Form 1).

Without this, your Sale Agreement is just a piece of paper. Under the Land Control Act, any transaction involving agricultural land that lacks LCB consent becomes null and void after 6 months.

Why do you need it?
✅ It proves the seller is legitimate.
✅ It prevents "double allocation" (selling to two people).
✅ It’s a mandatory requirement to get your Title Deed.

What happens at the Board?
You and the seller appear before the local Sub-County board. They’ll verify the price, the land size, and ensure everything is transparent. Once they say "Yes," you get your Letter of Consent and move to the final stage of registration!

Most people think a Title Deed or a search is the final proof of ownership. It's not!

The real story of any property in Kenya is found in one place, the Green Card at the Land Registry under the Ministry of Lands and Physical Planning.
