TODAY I WANT US TO TALK ABOUT A WILL
A WILL is an expression of a wish of a dead person on how he would wish his properties to be distributed upon his death.
A WILL can either be 'written' or 'oral' .
WRITTEN WILL can take any form i.e it doesn't have a specific format.
A WILL can also be written on any material even on leaves so long as it is visible.
WRITTEN WILL will only be valid/accepted by Court for use if it has the following components:-
1. If it is signed by the author.
2.If it is witnessed by atleast 2 competent adults (person of age and sound mind)NB: The witnesses must sign in the presence of author.
NOTE:It is important to leave a will as this would be the best way to avoid disputes on the mode of distribution.

DISPOSE OF A DECEASED PERSON 'S 'IMMOVABLE PROPERTY' BEFORE COMPLETION OF SUCCESSION.

Today I want us to talk about transacting on deceased person's property before completing a succession. 'Succession' simply means the process of conferring/ transmission of the deceased person's estate to his /her beneficiaries.
Any sale of 'immovable property' e. g land, house etc carried out before the completion of succession (before obtaining 'Certificate of Confirmation of Grant') constitutes to intermeddling with the deceased person's estate and is a criminal offence punishable under the law. It attracts a fine of not less than Ksh. 10,000 or a jail term of not less than one year or both.
Further such sales are deemed to be null and void. The buyer will not have any legal remedy for purchasing a parcel of land or a house before the succession process is completed.
To avoid such mistakes ensure that a succession has been carried out on the parcel you intend to buy.
To know if the succession process has been completed, request to see a copy of CERTIFICATE OF CONFIRMATION OF GRANT.
This is the surest way to know whether a succession process was completed.
Do not lose money. Follow the due diligence before proceeding to purchasing any immovable property from the estate of the deceased.
