In land ownership, *joint ownership* (joint tenancy) and *ownership in common* (tenancy in common) differ mainly in how ownership shares are held and what happens when an owner dies.

Example
Suppose Peter and John own a parcel of land:
Joint ownership: If Peter dies, John automatically becomes the sole owner of the entire land.
Ownership in common: If Peter owns 60% and John owns 40%, Peter's 60% share passes to his heirs or beneficiaries, not automatically to John.
In Kenya, both forms of co-ownership are recognized under the Land Registration Act. When purchasing land jointly, it is important to specify whether the ownership is as joint tenants or tenants in common because the legal consequences are significantly different.

Registering a Business Name is not the Same as Owning the Name many People Learn this too late

This confusion costs people years of effort but let’s clear it plainly,

There are three different registrations people mix up all the time:

🥢 CAC registration
🥢 Trademark registration
🥢 Patent registration
They do very different things.

When you register a business or company with the Corporate Affairs Commission (CAC), the government is simply saying:
“This name can exist as a business entity.”
That’s all.

CAC registration:
✔️ Allows you to operate legally as a business
✔️ Lets you open bank accounts
✔️ Gives your business legal personality

But here is the shocker. CAC does NOT give you ownership of the name as a brand. Someone else can still legally use that same name For products
for services, online, as a brand. As long as they are not using your exact registered business entity.
CAC protects existence, not brand ownership.

Trademark registration is what protects a name, logo, or slogan as a brand.
It answers the question:
“Who owns this name in business and commerce?”

Trademark registration:
🥢 Gives exclusive rights to use the name for specific goods or services
🥢 Prevents others from using a confusingly similar name in the same class
🥢 Allows you to stop imitation, confusion, and brand hijacking
This is why two companies can exist with similar names under CAC but only one can legally own the trademark for a particular class of business. In short Trademark protects identity.

Patent registration has nothing to do with names.
It protects:
🥢 Inventions
🥢 New products
🥢 Processes
🥢 Technical solutions
A patent answers this question:
“Who invented this, and who can commercially use it?”

Patent registration:
🥢 Protects how something works
🥢 Gives exclusive rights over an invention for a limited time
🥢 Has nothing to do with business names or branding
