New title deed cannot legally be issued without revoking or canceling the old one. Here's why and how it works:
- Legal Principle
Only one valid title can exist for a piece of land at any given time.
* When can a New Title Deed May Be Issued:
1.) When reported as Lost Title Deed:
You must apply for a replacement.
A notice is published in the Kenya Gazette.
After 60 days with no objection, the old title is revoked and a new one issued.
2.) Title Correction (e.g., name change, typo):
The original title is surrendered, corrected, and replaced.
3.) The old one is nullified in the registry.
4.) Land Subdivision or Transfer:
The parent title is closed and new titles are created for the portions or new owners.
5.) Succession:
After court process, the old title is revoked and a new one is issued in the heir's name.
โNOTE : If a New Title Is Issued Without Revoking the Old One:
It's considered fraudulent or illegal.
Can lead to land disputes, double ownership claims, or court cases.
