This video examines the difference between legal recognition and real justice.
In foreign investment cases, legal rulings only provide protection if they are enforced. When arbitration awards and court decisions exist solely on paper, investor protection remains theoretical rather than effective.
In this case, a foreign investor prevailed in international arbitration. Mongolian courts later confirmed that ruling against the local partner. The decisions were final, binding, and legally valid.
Yet on the ground, nothing changed.
Rights existed in documents, but not in practice. Control of the project did not return, and enforcement did not follow recognition.
For European policymakers and observers, this distinction is critical:
legal certainty depends not only on judgments being issued, but on their implementation.
This is not a commercial disagreement.
It is a question of enforcement and access to real justice.
