After years without effective enforcement of binding legal decisions, the foreign investor escalated the matter beyond enforcement authorities and courts. In March 2023, a formal written complaint was submitted to the Minister’s Office of Mongolia.

The complaint detailed what had occurred with the Global Residence project in Zaisan, Ulaanbaatar, and outlined why internationally binding and domestically recognised court decisions against the local partner had not been enforced.
The Minister’s Office reviewed the submission and acknowledged that the case involved potential violations of a foreign investor’s rights. The matter was formally transferred to the Minister of Justice and Internal Affairs and to the General State Prosecutor for examination and action.

Despite this escalation, the situation on the ground did not change.

For European policymakers and observers, this raises a fundamental governance question:
