赌鬼做 𝗳𝗮𝗸𝗲 𝗗𝗼𝗰𝘂𝗺𝗲𝗻𝘁, 拿钱跑路!
My father was a pineapple farmer 𝗶𝗻 𝗠𝘂𝗮𝗿, with 𝟭𝟭 𝗮𝗰𝗿𝗲𝘀 𝗼𝗳 𝗹𝗮𝗻𝗱. He passed away in 1977, and I inherited the land.
I had no experience in 种植, and people from my 𝗸𝗮𝗺𝗽𝘂𝗻𝗴 𝗠𝘂𝗮𝗿 wanted to keep farming it. So in August 1979, I rented the land to Mr. Goh. But after just one year, his plan failed due to various issues, and the land was 𝗹𝗲𝗳𝘁 𝘃𝗮𝗰𝗮𝗻𝘁 ever since.
In 1982, my mom—who still stayed in Muar kampung—called me screaming:
“你怎么可以这么不孝!你爸爸生前讲过啊 ,这个地是不可以卖掉的!你尽然没和我商量就自作主张 ,就让银行的人来收掉这个地 ,ah弟啊 ,怎么你可以这样!!!”
I was 𝗰𝗼𝗺𝗽𝗹𝗲𝘁𝗲𝗹𝘆 𝗰𝗼𝗻𝗳𝘂𝘀𝗲𝗱 😰. I told her: “你有没有搞错,我没有把地卖掉啊” and asked her to relax, promising to investigate and let her know the truth.
After getting to the bottom of it, I uncovered the shocking fraud: 𝗠𝘆 𝟭𝟭 𝗔𝗰𝗿𝗲𝘀 𝗼𝗳 𝗹𝗮𝗻𝗱 𝗵𝗮𝗱 𝗯𝗲𝗲𝗻 抵押 𝘁𝗼 𝗥𝗫𝗫 𝗕𝗮𝗻𝗸 𝗳𝗼𝗿 𝗮 𝗥𝗠𝟯 𝗺𝗶𝗹𝗹𝗶𝗼𝗻 𝗹𝗼𝗮𝗻—by someone named 𝗧𝗮𝗻 𝗔𝗵 𝗚𝘂𝗶 (阿贵). He did it using a 𝗳𝗮𝗸𝗲 𝗣𝗼𝘄𝗲𝗿 𝗼𝗳 𝗔𝘁𝘁𝗼𝗿𝗻𝗲𝘆 (PA) (授权书)!
I had two burning questions:
*First, 𝘄𝗵𝗼 𝘁𝗵𝗲 𝗵𝗲𝗰𝗸 𝗶𝘀 阿贵?
*Second, how could he forge a document without my signature or any authorization?
𝗪𝗮𝗹𝗮𝗼 𝗲𝗵, 𝘁𝗵𝗲 𝗹𝗮𝘄𝘆𝗲𝗿 𝗮𝗻𝗱 𝗯𝗮𝗻𝗸'𝘀 𝘀𝗮𝗳𝗲𝘁𝘆 𝗽𝗿𝗼𝗰𝗲𝗱𝘂𝗿𝗲 这么 𝗟𝗮𝗼-𝘆𝗮 & 𝗞𝗡𝗦?
Overnight, I was stuck with a 𝗥𝗠𝟯 𝗺𝗶𝗹𝗹𝗶𝗼𝗻 𝗱𝗲𝗯𝘁 𝗳𝗼𝗿 𝗻𝗼 𝗿𝗲𝗮𝘀𝗼𝗻—and if I didn’t pay, I’d lose the land my father left me. 太没天理了!
I consulted a lawyer friend, who advised me to 𝗳𝗶𝗴𝗵𝘁 𝗳𝗼𝗿 𝗺𝘆 𝗿𝗶𝗴𝗵𝘁𝘀 to get back the land—since the PA was clearly fake.
He explained: A Power of Attorney is a legal document where the owner (me) gives someone else (the attorney—阿贵) the power to make decisions and sign papers on their behalf. But 阿贵 had 𝗳𝗼𝗿𝗴𝗲𝗱 𝗺𝘆 𝘀𝗶𝗴𝗻𝗮𝘁𝘂𝗿𝗲.
After months of 人肉搜索, I found out 阿贵 was actually from my 𝗠𝘂𝗮𝗿 𝗞𝗮𝗺𝗽𝘂𝗻𝗴! My Muar relatives told me he was a 赌鬼 who’d even borrowed money from my father before. He knew Mr. Goh’s farming failed and my land was vacant—so he seized the chance to 神不知鬼不觉地 𝗺𝗮𝗸𝗲 𝗳𝗮𝗸𝗲 𝗱𝗼𝗰𝘂𝗺𝗲𝗻𝘁𝘀, 𝗺𝗼𝗿𝘁𝗴𝗮𝗴𝗲 𝘁𝗵𝗲 𝗹𝗮𝗻𝗱, steal RM3 million, and 跑路!
𝗚𝗼𝗱 𝗱𝗮𝗺𝗻 𝗶𝘁, 𝘁𝗵𝗶𝘀 阿贵 𝗶𝘀 𝗮 𝗳𝗸𝗶𝗻𝗴 𝗮𝘀𝘀𝗵𝗼𝗹𝗲! 🤬
我不信邪!—this was my father’s legacy! The legal battle with RXX Bank lasted 10 years, going through three levels of courts:
* 2003: High Court – Winner: The bank
* 2009: Court of Appeal – Winner: The bank
* 2010: Federal Court (最高法院) – Winner: Me (𝗢𝗵 𝘆𝗲𝘀, 𝗺𝗮𝗺𝗮 𝗶 𝗱𝗶𝗱 𝗶𝘁 !!! 𝗝𝘂𝘀𝘁𝗶𝗰𝗲 𝗶𝘀 𝘀𝗲𝗿𝘃𝗲𝗱!) 🎉🥳😭
In the first two trials, the bank’s legal team was ruthless. Their main arguments:
* They were an “innocent party”—they didn’t know the PA was fake, had lent RM3 million based on the mortgage, followed SOP, and the PA looked real (stamped and registered at the High Court).
* They used a “Golden Shield”: A previous Federal Court ruling that said even if a document was forged, innocent buyers/banks got “immediate indefeasibility” (can’t be challenged) under Malaysian law at the time—once the charge was registered at the land office, it was unbreakable, even if fraud was involved.
But the Federal Court finally broke the bank’s shield! 🚫🛡️
The Chief Justice used previously cases which was similar (2010 cases ) to fix the “national crisis” of land fraud which They changed Section 340 of the National Land Code (which was previously 骗子的天堂) and ruled that a forged document (PA) is a “void Instrument” (legal trash). You can’t build a legal “castle” on a “garbage” foundation—so the mortgage from the fake PA was also invalid!
Final Outcome:
* The bank lost the RM3 million loan (they had to hunt down the fraudster 阿贵 themselves).
* My name was put back on the land title (Geran), and the bank’s name was deleted.
* The bank had to pay me RM100k in legal costs.
十年讼战,终得昭雪—justice finally prevails! ✨🙏
Lessons learned from this case study
✅ Scammers love targeting vacant 𝘁𝗮𝗿𝗴𝗲𝘁𝗶𝗻𝗴 𝘃𝗮𝗰𝗮𝗻𝘁 𝗹𝗮𝗻𝗱—original owners rarely check on it, so scammers have plenty of time to take the money and run.
✅ Use the 𝗘-𝘁𝗮𝗻𝗮𝗵 𝗕𝗶𝗼𝗺𝗲𝘁𝗿𝗶𝗰 𝗦𝘆𝘀𝘁𝗲𝗺: Once registered, no land title transfer can happen unless you show up and scan your thumbprint.
✅ 𝗙𝗶𝗹𝗲 𝗮 𝗣𝗿𝗶𝘃𝗮𝘁𝗲 𝗖𝗮𝘃𝗲𝗮𝘁 (大大的安全锁🔒 on your land title): This freezes the title—no new names or bank charges can be registered at the land office.
