I , LIAN KIM MOON ( NRIC NO : 950628-14-###X ) with an address of service at Suite 12-2, Level 2, Wisma Menjalara, Jalan 7A/62A, Bandar Menjalara, 52200 Kuala Lumpur HEREBY APOGISE to PERDANA PARKCITY SDN BHD ( COMPANY NO : 197701002676 (33751-K) with an address of service at C-3-1, Plaza Arkadia, No.3, Jalan Intisari Perdana, Desa Parkcity, 52200 Kuala Lumpur for infringing and passing off the trademark DESA PARKCITY and/or PARKCITY and/or its variations by promoting and marketing that LAKE CITY @ KL NORTH at Taman Wahyu, Kuala Lumpur, among others, as Desa ParkCity 2.0 , Desa ParkCity Concept and/or development by Desa ParkCity developer without the consent of PERDANA PARKCITY SDN BHD.
I HEREBY ACKNOWLEDGE that PERDANA PARKCITY SDN BHD is the common law and registered proprietor of DESA PARKCITY and/or PARKCITY , which are duly registered with the Intellectual Property Corporation of Malaysia under the Trade Marks Act 1976. I FURTHER ACKNOWLEDGE that PERDANA PARKCITY SDN BHD is not the developer of Lake City Project which I had identified, promoted and marketed as Desa Park, Park City 2.0 and Desa Park City 2.0.
I HEREBY UNDERTAKE to immediately retract, cease and desist the distribution, storage, offering for sale and advertising pamphlets and brochures and the use of the trademark DESA PARK CITY and/or PARKCITY and the name Desa Park, Park City 2.0 and/or any products or services identical with or so nearly resembling PERDANA PARKCITY SDN BHD trademark for the LAKE CITY @ KL NORTH project.
I sincerely apologise for any inconvenience, losses and/or damages suffered by PERDANA PARKCITY SDN BHD as a result of the aforesaid infringement and/or passing off and/or deceptive use of PERDANA PARKCITY SDN BHD trademark.
TAKE NOTICE that PERDANA PARKCITY SDN BHD will not hesitate to initiate legal action against any party who infringed the intellectual property rights owned by Perdana ParkCity Sdn Bhd and such party will be liable for all damages, costs and expenses incurred thereon.
