The Real Property Gains Tax (RGPT) in Malaysia applies to individuals who sell properties and realize capital gains. The rates vary based on the property's holding period and the seller's residency status. Below is a detailed overview of RPGT rates for individuals effective from 2023 onwards (post-2022 amendments).

KEY NOTES:_-
1. Exemption for Malaysians (6+ years): No RPGT is charged if the property is held for 6 years or more.

2. Foreigners: Pay a flat 10% RPGT after the 5th year (no full exemption).

3. Calculation Basis: RPGT is calculated on the net chargeable gain (selling price minus purchase price and allowable expenses).

4. Tax Exemptions & Reliefs:
i) Once-in-a-lifetime exemption for gains up to RM10,000 or 10% of the total gain (whichever is higher).
ii) Other exemptions may apply for inherited properties or disposals between family members.

Malaysian individuals benefit from lower RPGT rates compared to foreigners, with full exemption after 6 years. Foreigners continue to pay RPGT even after long-term ownership. Proper tax planning and documentation are essential to optimize liabilities.
