The recent decision of the Federal High Court in Air Peace Limited v. Federal Competition and Consumer Protection Commission "FCCPC", delivered by Hon. Justice James Omotosho, is a clear judicial affirmation of the statutory mandate of the Commission under the Federal Competition and Consumer Protection Act "FCCPA", 2018.

The matter arose from the Applicant’s challenge to the authority of the FCCPC to issue investigative summons and take regulatory steps in relation to consumer complaints bordering on ticket refunds and alleged unfair market practices. Air Peace contended, in substance, that the Commission acted outside the scope of its enabling law and sought to interfere with matters falling within the airline’s commercial discretion.

The court rejected this argument and dismissed the suit in its entirety. It held that the Commission is duly empowered under the FCCPA to receive complaints, conduct investigations, and issue summons where necessary for the protection of consumers and the maintenance of fair market conduct. The court further held that the exercise of such statutory powers cannot be defeated merely by the fact that the subject matter arises from a regulated industry such as aviation.

The judgment is significant for restating a key principle of administrative law: that statutory bodies derive their authority strictly from their enabling legislation, but where such authority is clearly granted, the courts will not interfere with its lawful exercise. In this case, the FCCPC was found to have acted within the four corners of its statutory mandate.

It is important to note that the court did not pronounce on the issue of price regulation or confer any power on the FCCPC to fix or control airline fares. Rather, the decision is confined to the Commission’s investigative and enforcement jurisdiction in relation to consumer protection complaints. The distinction is material, as it preserves the principle that pricing decisions remain within the domain of commercial entities, subject only to lawful regulatory scrutiny where consumer rights are implicated.

Accordingly, the case does not establish regulatory price control over airlines, but it does affirm that commercial enterprises operating within Nigeria’s market structure are not insulated from investigation or oversight where allegations of consumer rights violations arise.

In conclusion, Air Peace Limited v. FCCPC reinforces the legal balance between commercial autonomy and consumer protection. It confirms that while businesses retain discretion in their operations, such discretion is not absolute and may be subject to lawful inquiry by competent regulatory authorities acting within their statutory limits.
