Stop using “Mr/Mrs Daniel” on your property documents

It looks sweet and united but in the real sense of law, it is a trap.

Now, picture this

You and your spouse buy land together. On the Deed of Conveyance, the lawyer writes: “Mr/Mrs Daniel” as the purchaser.
You smile, thinking it shows joint ownership.
Wrong.

In property law, “Mr/Mrs Daniel” refers to the man alone as if he bought the property in his sole name. The wife’s interest is not protected.

If you truly want co-ownership, the names must be written clearly, for example:

🥢 “Daniel Chukwuemeka and Rose Daniel (husband and wife)”

🥢 “Mr. Daniel Chukwuemeka and Mrs. Rose Daniel, jointly as purchasers.”

OR

1. Mr Daniel Chukwuemwka
2. Mrs. Rose Daniel
(Purchasers)

That way, both names appear distinctly, and the law recognizes both parties as owners.
I’ve seen too many cases where a widow was pushed out of her home because the document only bore her husband’s name even though she contributed.

In law, love is not ownership.
If you want joint ownership, write your names clearly. That will save you from future regrets.

How you listen matters! Over the weekend I was on call with a client and she was telling me how she was hurt over a real estate investment that went south.

I was busy listening to her and from her voice I sense pain and a feeling of disappointment over real estate investment here in Nigeria. The lady was based in diaspora and made some real estate investment through one of her close family friends.

She told me how much she has invested and even sent me the receipt of the transfer she made. The annoying part is that, the close family friend she invested through him, told her that she had been allocated and even sent her a false video of allocation. This is a property worth over 35 million Naira about two years ago.

Then early this year she contacted the family friend that she wants to start a building project on the land. That she has a building engineer that will start the building project for her. She requested, that the family friend should take the engineer to the land to start the project. That is when the story started.

The family friend said that the estate company that has the property, has lost the property to the government and the estate company is looking for another location for the investors.

The lady asked him since when did this development happen and he said it is over a year now. Could you imagine! Such development happens and you could not inform the person who invested such an amount! about the update.

When I asked the lady, what is the name of the estate company you made payment to , she said it was a personal account the family friend sent to her. At this point I became speechless.

To cut the long story short, the guy, could not provide the name of the estate she allegedly invested with and the land she paid for.

When she involved the police and got the guy arrested,it happened that the guy just lured her to invest in a land that never existed. At this point I knew why this lady has trust issues.

This experience of hers was really traumatic for someone who is investing for the first time.

This is the reason why a realtor should try and engage some of these clients that seems they are having trust issues. Alot have been betrayed by people they initially trusted. It your responsibility as a realtor to guide your clients to invest following the proper due diligence, before committing his or her hard earned money. It takes wisdom to listen.

I always tell first time investors or anyone who is investing in real estate. To consider these factors before committing your hard earned money into any investment.

Ask for the real estate company's name that owns that property. Check for other people's reviews on Naira land who have invested with them. Everything is online.

Consider the longevity of the company and the way by which they operate,do they give instant allocation or delayed allocation. If allocations take more than 3 months please run!

Don't ever pay money into a personal account especially when you are buying from an estate company. Except if it is an individual property.

Do your land search to make sure you are not buying a government property. You can do this through a land surveyor.

Check for the kind of documents they issue after payment. At least you should be expecting a Deed of assignment, irrevocable power of attorney and survey plan,then a C of O if it is stated before purchase.

If possible go the extra mile and ask questions from the locals I mean the original owners of the land how that property was acquired. Because some estate companies are selling property that is in dispute with the original owners.

Then before you purchase from the estate,try and follow them on social media and observe how they operate.

I believe this will be a good step by step breakdown on how to avoid company scammers and individual scammers. The real estate market is getting more attractive and is attracting both genuine and scammers and you need to be very careful when you want to invest.

The mistake every realtor must avoid is this particular scenario, that led to the Kpaing of Mr Richard the vice chairman of the real estate association in Bayelsa state. According to the narration of what is transpared as narrated by Very Dark Man, between Mr Richard( Realtor) and Mr George ( Landowner).

In every real estate transaction, trust is the skeleton that makes a transaction possible. But trust without following the standard procedure of a real estate transaction is detrimental and most times, bring greed into the transaction. On no account should you allow your client to pay money to a landowner, without you and your client seeing the original document and having the duplicate of that document.

In a standard real estate transaction that involves an individual property. The standard procedure should be as follows:

The Landowner, provides the original land documents of the land that he wants to sell while the real estate agent carries out his due diligence by confirming the authenticity of those documents through the ministry of land of that particular state, if the land is duly registered.

After the verification of those documents and is confirmed to be genuine. There is still need to do some underground search from the locals to know if there's dispute on the land. And to know the original Landowner of that property and how the ownership was transferred to the current owner. This is what a realtor should do without the knowledge of the seller.

The second step is to ask your client to get a registered surveyor to confirm the actual size of that property and a legal practitioner who prepares deed of assignment which is a document that shows a transfer of ownership from the seller to the buyer and another document which is irrevocable power of attorney. During this process no money has been transferred to the seller. When these documents are ready, the real estate agent should schedule a neutral meeting point mostly public place for the transaction to happen properly.

At the point of this transaction the following people should be present :
The owner of the property and his witness
The buyer and his witness
The real estate agent
And anybody who is involved during the real estate transaction.
It's at this point that money should be transferred to the seller and on confirmation of the money by the seller, the documents will now be signed by both parties. One copy each of the new documents not the original should be given to the seller that is the "now formal owner" of the land while the current owner of the land collects the old documents from the seller leaving him with only a copy that is not the original. At this stage a successful transaction has happened without having casualties.

What gave room to this incident was the real estate agent having 💯 trust on the Landowner without following this standard land transaction procedure.

No real estate transaction is small, whether hundred of thousands or in millions. Trust is necessary but trusting someone in a land deal without following due diligence is a time bomb, just expect anything. Is just like buying a land without the land documents just because you know the person selling,it won't end well.
