Every property owner in Edo State needs to see this 👇
The Edo State Land Use Charge Law 2023 was signed by the Governor on 6th June 2023 and most people in Benin City still do not know what it says or how it affects their property.
Let me break it down for you simply.
If you own property in Edo State you are required by law to pay Land Use Charge every year. Even if you are a tenant on a lease of more than 3 years you are also liable.
How much do you pay?
It depends on what you use your property for:
If you live in your own home you pay 0.040% per year
If you rent out your property you pay 0.150% per year
If you run a shop or office you pay 0.375% per year
If it is industrial property you pay 0.200% per year
If it is a school or hospital you pay 0.100% per year
If it is farmland you pay 0.075% per year
If the land is vacant or undeveloped you pay 0.025% per year
Good news — if you are 70 years and above and living in your own home you are completely exempted. Places of worship, public cemeteries, public libraries and palaces of traditional rulers are also exempted.
But here is what most people do not know 👇
If you receive a Demand Notice and you do not pay within the deadline the penalties start adding up fast.
After 45 days — extra 10% added
After 75 days — extra 20% added
After 105 days — extra 30% added
After 135 days — they can take enforcement action on your property
That means they can go to court and take action against your property until every kobo is paid.
Do not ignore your Demand Notice.
Also — always pay into the designated bank account listed on your notice. Never pay cash to any individual. It will not be recognised under the law.

🏠 CERTIFICATE OF OCCUPANCY (C of O) FEES

Prime Charge: N50,000 flat for ALL C of O applications covers application, advertisement, preparation and administrative charges.

Non-State Land Premium Rates:
Residential — N10 per sqm
Commercial — N25 per sqm
Industrial — N50 per sqm
Agricultural — N0.25 per sqm
Public Institutions — N12.5 per sqm

State Land attracts a multiplier of x2.5 for residential and commercial, and x1.5 for industrial, agricultural and institutional.

Zone A — High Value District (above N50M): x2.5
Zone B — Upper Value District (N25M–N50M): x1.5
Zone C — Mid Value District (N15M–N25M): x1.0

📝 SUBSEQUENT LAND TRANSACTION FEES

Every time land changes hands in Edo State these fees apply:

Governors Consent Fee — 1.5%
Stamp Duty — 2.0%
Capital Gains Tax — 2.5%
Mortgage Consent Fee — 0.5%

Total transaction cost on every land transfer: approximately 6.5% of property value.
