So, let’s get to it. You see the reason a title is a title, is because it is very assuring

There are quite a number of titles but survey plan is not one of them

Yes, some claim that a survey plan is a title but it isn’t

You see, one portion of land can have up to ten, fifty, one hundred survey plans. So, it is not an assuring title to the land.

A lodged survey plan, lodged at the surveyor general’s office, to some extent protects the buyer

To make your land more assuring though, you need to have other titles. Other titles such as an Excision, a Gazette, a C/O, a Governor’s consent or Government land allocation

Among the kind of survey’s that exist, a registered survey and a provisional survey.

A registered survey is the one that is lodged at the surveyor general’s office while a provisional survey can be made in their 100s without any of them being lodged at the surveyor general’s

So, registered survey simply means that, there is a copy of the survey plan you are getting, at the surveyor general’s office of the state too.

And you can see that copy at the surveyor general’s office. Others can search it out there too

When you want to buy a land, it important that you only buy if the land has other titles other than the registered survey.

Besides, the provisional survey is never lodged at the surveyor general’s office. It is only in your house and in your surveyor’s house/office. That’s all

The surveyor who draws a registered survey plan is the one who will lodge it at the surveyor general’s office, not you. So, you have to ensure he lodges it

Thus, the only kind of property you can search is one with a registered survey but don’t buy it even after a positive search, if all it has is a registered surveyor and a deed

A provisional survey does not give a protection and cannot be searched.

Blue copy, stamp, local government, name of surveyor, name of buyer, name of area are things you will find on a registered survey

The way to know a provisional survey most times, is that you will see something like LA/PROV written on it but interestingly, some surveyors will not put that on a provisional survey plan.

So, to be sure the survey plan is a registered one, ask for AN EVIDENCE OF LODGMENT

An evidence of lodgment is the evidence that he lodged the registered survey at the surveyor general’s

And to confirm, you can visit the surveyor general’s office to find out if the survey plan was indeed lodged as a registered one

Also, if you want to buy from an estate or from a real estate company, you will see the name and number of the surveyor on the registered survey plan.

So, you only need to call him to ask for an EVIDENCE OF LODGEMENT, which you can then use to search at the surveyor general’s

One benefit of the survey plan is that it makes you know what portion of the earth’s surface belongs to you otherwise, there will be conflicts and you won’t know what belongs to you.

That’s why we have coordinates on survey because no two coordinates can be the same

Now, I believe you see why it is not out of place for you to pay a real estate company that you trust, the survey fee they ask for?

Why should one surveyor handle it all for an estate?

Because the mapping out, the separation into plots and all whatnots were done by him and for ease, simplicity

And orderliness, it is only reasonable that that same surveyor continues to handle it all

In like manner, because every lawyer has his own different way or drafting a deed of assignment and putting up clauses.

It is also best for the sake of uniformity, orderliness and simplicity, that one lawyer drafts all the deed of assignment for an estate

But in all these, you must also bring your own trusted surveyor and your own trusted lawyer who both know their onions, to confirm these things for you

A case in point was one time when a client bought 12 plots of land, thinking each was 600sqm as advertised to him by his realtor, only for his surveyor to find out for him that he was sold 500sqm (which was what the company intended to sell).

However, to please the client who already paid, he was given extra plots to fulfil 600sqm each
