The Lagos State Tenancy Law has been updated to better protect tenants and regulate landlord practices. Here are the key provisions:

1. Advance Rent Restrictions

Landlords are prohibited from demanding more than three (3) months' rent in advance from sitting tenants. Similarly, tenants are not allowed to pay more than three months' rent upfront. Violations can result in fines up to ₦100,000 or imprisonment for up to three months.

2. Mandatory Rent Receipts

Landlords must issue rent payment receipts to tenants, detailing the payment date, names of both parties, property location, amount paid, and the rental period covered. Failure to provide a receipt can lead to a ₦10,000 fine.

3. Tenancy Agreement Fee Cap

The Lagos State Government has reaffirmed that tenancy agreement fees should not exceed 10% of the annual rent. Landlords and agents charging above this limit are in violation of the law.

4. Notice Periods for Termination

In the absence of a written agreement, the law stipulates the following notice periods:

One week's notice for a weekly tenant

One month's notice for a monthly tenant

Three months' notice for a quarterly or half-yearly tenant

Six months' notice for a yearly tenant

If a monthly tenant is in arrears for three months, the landlord may seek possession through the courts.

5. Tenant Rights

Tenants are entitled to:

Reasonable privacy

Freedom from unreasonable disturbance

Exclusive possession of the premises

Use of common areas for lawful purposes

Additionally, tenants who make improvements with the landlord's written consent may claim compensation if the tenancy is terminated.

6. Dispute Resolution

Tenancy disputes can be addressed in either the High Court or Magistrates’ Court within the relevant jurisdiction.

7. Prohibition of Unlawful Evictions

Landlords must not evict tenants without following due legal process. Self-help evictions are prohibited and can result in legal penalties.

For further details or to report violations, tenants can contact the Lagos State Real Estate Regulatory Authority (LASRERA). The Lagos State Government's position is that the total charge for legal and agreement fees combined should not exceed 10% of the annual rent.

Example:

If the annual rent is ₦1,000,000:

Total charge for both legal and agreement fees together should be ₦100,000 or less.

This means legal = 5% and agreement = 5%, or any other breakdown, as long as the total does not exceed 10%.

Anything above this is considered illegal under the Lagos Tenancy Law.

Before you buy land from Omonile (Family Land)

1. Make sure the Head of Family knows about it and is involved in the transaction, it's very important.

2. Before paying, get a surveyor to help you get the coordinates of the land so as to be sure that the land is free from Government acquisition and also to make sure say no be road dem wan give you.

No go buy G0vt land o, omonile no sabi that one oooo....dem even fit sell road for you

3. Get a lawyer to help you prepare the Deed of Assignment and ensure it's a registered deed of assignment

4. Don't foeget to take possession

Even if na dwarf fence and small foundation then keep on doing something on the land every month, no matter how small

Even if na 30 blocks, add to it every month.

Possession is very important in land matters

5. Pls confirm that the family is not having c0urt case with another family on that Land and if they have, pls ask for the judgement paper so you can be safe

Living Abroad and Building for Caretakers to Enjoy.

The Wisdom of the African.

I recently argued that many caretakers looking after the properties of those living abroad are the true owners or beneficiaries of these properties.

Usually, an African will erect a beautiful house back home while living abroad and then another person called a caretaker will be employed to live in the house, enjoy the house and watch over the house every day.

The legal/actual owner visits once a year for about 2-3 weeks to enjoy the property. The caretaker enjoys it every day.

Interestingly, the caretakers enjoy the property right from completion, when everything is fresh and beautiful. The legal owner may finally return home 10 or 15 years later, if lucky, to enjoy the remnant of the property; when style, taste, and beauty have all diminished.

Why? Because we are told this is what we ought to do. Build back home when you are never there, spend your money on things far away from you, for others to enjoy.

Even if I was not a minimalist, I couldn’t also see any good reason why a person with a family size of 3 or 4, wife and a child or two children, would build a 9-bedroom house in Africa; leaving about 6 rooms empty all the time to be occupied probably by the ghosts of their ancestors. Obviously a wastage in having a 9-bedroom family house, that the rooms are never used by the family, and the cost of maintenance is always a financial drain or another waste of resources.

You wouldn’t go and buy 10 doughnuts in the morning and just eat 3 and throw away the 7, simply because you can afford them. So why do the same with buildings?

I know someone who is building a 12-bedroom house in his village as his personal residence and this has taken 9 years so far, he is still on it. In the meantime, he is renting a small room in the US and he says he will one day leave to go back home to live in his mansion. He may die in US. Currently the design of this mansion is even outdated, and he has at least 5 years more to complete based on the pace.

In 2018, a certain young man, 43 years, died in the USA from a heart attack while asleep. It was 3 days after his death that he was found. He too was living in a small room, working 16 hours a day for 6 days and putting all his monies into building a 9-bedroom house back home on a piece of land he bought. When he died, his family/wife sold the house. It was too big for them to even maintain if it was completed. This was not also completed.

A lot of Africans abroad indeed build houses back home to create a certain impression of themselves or just to show off, and while doing so, they forget to live in the moment thinking they will one day, when on pension or old, go and enjoy these houses.

Who is an old man or woman going to impress? At 65 and over, you will be frail, battling to live each day and no one will care. How many people really live to enjoy anything beyond the pension age? At age 65 or 70. What would you be doing with a 12-bedroom residential house? In fact, how are you going to climb the stairs at that age?

When white people get old, they sell their huge houses to downsize, but we seem to want to live like rats when young and energetic, and then live like kings and queens when we are about to die.

While we must plan for the future, we must do so prudently and with the wisdom that today is all we really have, the future is a probability. Don’t grossly neglect your now because of a probability; tomorrow.

Invest in your future but do so while living a meaningful and balanced life today.

Nigeria's housing sector has failed to adequately accommodate the needs of low- and middle-income families.

As a result, moving up the property ladder is as challenging as getting a first foot on it. In many cases, house prices are out of reach for a majority of the population.

Nigeria has an estimated 28 million housing deficit as of 2023, indicating that the country needs at least 28 million housing units to provide adequately for the population.

An estimated sum of N21 trillion is required to provide housing units to fill the deficit.
