But… you’re already asking me to market it. 😅

This is something many property owners don’t realize:

Finding the buyer isn’t when a broker’s work begins.

Before that buyer ever sends “Available pa?”, we’ve already prepared the listing, advertised the property, answered inquiries, screened prospects, coordinated viewings and communicated with potential buyers.

And here's what the law actually says:

Under Republic Act No. 9646 (Real Estate Service Act of the Philippines), the work of a real estate broker includes acting for another, for professional fee or commission, to:

• offer
• advertise
• solicit
• list
• promote
• mediate
• negotiate
• or effect the meeting of the minds in a real estate transaction.

In other words:

Marketing is already part of brokerage.

The Civil Code also recognizes agency as acting in representation or on behalf of another with the consent or authority of that person.

And Article 1874 provides that when the sale of land or an interest in land is made through an agent, the agent’s authority must be in writing.

So if you're asking me to represent and market your property, I want our authority and agreed terms documented BEFORE I start doing the work—not after I finally bring you a buyer.

And the Authority to Sell isn't there just to protect the broker.

It protects the OWNER, too.

It puts our agreement in writing:

✓ What property am I authorized to market?
✓ What is the authorized selling price?
✓ Is the listing exclusive or non-exclusive?
✓ What is the agreed professional fee?
✓ How long is my authority valid?
✓ What exactly am I authorized to do?

And one important clarification:

An Authority to Sell is NOT the same as giving your broker unlimited authority over your property.

It establishes what the broker is authorized to do based on the specific terms you agreed upon.

This is why I don't believe in:

“Post muna, paperwork later.”

If you're trusting me enough to represent your property to the public and prospective buyers, let's establish that professional relationship properly from Day 1.
