Tamang proseso ng pag-subdivide ng lupa.

Marami ang nagkakaroon ng problema sa lupa dahil sa kakulangan ng tamang proseso at dokumentasyon. Para maiwasan ang aberya, mahalagang sundin ang legal at tamang hakbang sa pagsu-subdivide ng lupa.

Narito ang simplified guide:

✅ 1. Paghanda ng mga Dokumento

Siguraduhing kumpleto ang mga pangunahing requirements tulad ng:

• Original TCT/OCT
• Tax Declaration
• Valid IDs
• Deed of Sale / Kasulatan ng Paghahati
• Updated Tax Clearance at iba pa

✅ 2. Pagsusuri at Subdivision Survey

Kumuha ng lisensyadong Geodetic Engineer upang magsagawa ng actual boundary verification at subdivision survey ng property. Ito ang basehan ng tamang sukat at hati ng lupa.

✅ 3. Pagpapasa ng Plano

Isinusumite ang subdivision plan sa DENR-LMS para sa technical verification at approval ng plano.

✅ 4. Pagkuha ng Mga Permit at Clearances

Depende sa lokasyon at klase ng lupa, maaaring kailanganin ang:

• Barangay Clearance
• LGU Zoning Clearance
• DAR Clearance
• Environmental at iba pang permits

✅ 5. Pagpaparehistro ng Mga Bagong Titulo

Kapag approved na ang subdivision, ipoprocess naman ito sa Registry of Deeds at Land Registration Authority (LRA) para sa issuance ng bagong mga titulo.

✅ 6. Paglabas ng Individual Titles

Pagkatapos ng proseso, magkakaroon na ng hiwa-hiwalay na TCT para sa bawat subdivided lot — legal at ready for transfer, sale, or development.

⚠️ Paalala:

Ang proseso ay maaaring magbago depende sa lokasyon, classification ng lupa, at requirements ng local government agencies.

Kung kailangan mo ng tulong sa subdivision survey, lot subdivision processing, at land documentation, makipag-ugnayan lamang sa amin.

Who pays the Capital Gains Tax— the Buyer or the Seller?

The short answer: The Seller.

Think of it this way: Since the seller is the one making money from the sale, the government expects them to pay the tax on that profit.

How is it calculated?

The tax is 6% of the property’s value. The BIR doesn't just look at the selling price, though; they compare the price you agreed on against the "market value" (Zonal Value). They will charge the 6% based on whichever amount is higher.

The Bottom Line:

According to the law, the Seller is the official taxpayer. Because they are "gaining" from the deal, they are responsible for settling this with the BIR.
