Alinsunod sa Republic Act No. 12001, ipinagkakaloob ang Tax Amnesty para sa mga hindi nabayarang Real Property Tax (RPT) na naging delinquent bago ang Hulyo 5, 2024.

🗓️ Hanggang Hulyo 5, 2026 lamang ang pag-avail ng amnesty.

Beware of the word “CLEAN TITLE”

You can only call it clean title IF:

⭕ Owners that appears in the title of the property are still ALIVE & CAN SIGN documents

⭕ NO disputes attached in the title AND “certified true copy” of the title.
Please take note of the word “AND” because not all disputes are printed in the original title itself. Thus, it is very important to request for the latest certified true copy of the title.

⭕ All real estate taxes are paid on time. Always request for latest real estate tax clearance.

⭕ If the owners are married (on or after 1987) the property is considered conjugal even if only one property owner is in the title. Both should sign sale documents. Should the property owner dies, heirs should file and pay for the estate tax of all the properties.

⭕ If the property estate taxes are not yet paid, the property cannot be called “CLEAN”.

⭕ Magkaiba po ang real estate tax na binabayaran ninyo annually at ang estate tax (BIR FORM 1801). You only pay estate tax if the owner in the title is already dead. Penalties (like big penalties) apply for late filing.

🚨 HOT TAKE:
The ₱10-Million Pag-IBIG Housing Loan Increase Might SAVE the Condo Market… or Expose a Bigger Problem.

The government just increased the Pag-IBIG housing loan ceiling to:

🔥 ₱10 MILLION per borrower (Note: if qualified)

Yes, you read that correctly. Business Inquirer

At first glance, this sounds like GREAT NEWS for:
✔ aspiring homeowners
✔ middle-income earners
✔ OFWs
✔ developers
✔ the struggling condominium market

But let’s talk about the uncomfortable truth nobody wants to discuss.

📌 If Pag-IBIG now needs to finance up to ₱10 million properties…

Does that mean Philippine housing has already become TOO EXPENSIVE for ordinary Filipinos?

Because years ago:

* ₱1M to ₱2M homes were considered decent
* ₱5M was already “high-end”
* now even “ordinary condos” in Metro Manila can hit ₱8M–₱12M

Meanwhile:
⚠ salaries did not increase proportionally
⚠ land prices exploded
⚠ condo inventory piled up
⚠ rental yields weakened in some areas
⚠ many units became investor-driven rather than end-user-driven

And now Pag-IBIG appears to be stepping in partly to help absorb excess urban inventory — especially condominiums. (The Filipino Times)

That is the controversial part.

Because this raises difficult questions:

❓ Are we truly solving the housing problem?
—or merely extending financing to sustain elevated property prices?

❓ Are developers pricing according to actual Filipino affordability?
—or according to maximum financing capability?

❓ Will this genuinely help the middle class?
—or encourage more long-term debt dependency?

To be fair, there ARE advantages:
✅ lower interest rates than many banks
✅ up to 30-year financing
✅ improved accessibility for professionals and OFWs
✅ possible support for the real estate sector during inventory slowdown (Philippine News Agency)

But let’s be realistic as professionals:

A higher loan ceiling does NOT automatically mean:
✔ a good investment
✔ affordable monthly cash flow
✔ healthy market fundamentals
✔ sustainable property prices

This is where REAL ESTATE PROFESSIONALS must step up.

Not merely to “sell units”…

…but to educate buyers on:

* affordability
* cash flow
* rental demand
* oversupply risk
* exit strategy
* market cycles
* true investment analysis

Because the biggest danger in real estate is not high prices.

It is when people believe:
“as long as financing is available, the property is automatically worth buying.”

That mindset has destroyed markets worldwide.

Fully Paid ka na sa Bank/PAG-IBIG pero “Encumbered” Pa Rin ang Title sa Registry of Deeds?

Maraming property owners ang nagugulat kapag fully paid na nila ang housing loan nila sa Bank o PAG-IBIG, pero nang kumuha sila ng Certified True Copy ng titulo, nakalagay pa rin:

“Mortgage/Real Estate Mortgage”
o kaya
“Encumbered”

Normal ba ito?
Oo — at madalas nangyayari ito kapag hindi pa naipapa-cancel ang mortgage annotation sa Registry of Deeds (ROD).

Ano ang ibig sabihin ng “Encumbered”?

Kapag naka-encumbered ang title, ibig sabihin may nakarehistrong claim o obligasyon sa property — kadalasan ay mortgage sa bangko o PAG-IBIG.

Kahit fully paid ka na, mananatili pa rin ang annotation hangga’t hindi ito officially pinapacancel sa Registry of Deeds.

Sa madaling salita:

* Bayad ka na sa utang
* Pero sa records ng gobyerno, naka-mortgage pa rin ang property

Bakit importante na ma-cancel ito?

Kapag hindi na-cancel ang encumbrance:

* Magmumukhang may existing utang pa ang property
* Posibleng magkaroon ng delay sa bentahan
* Mahihirapan kang gamitin ito bilang collateral ulit
* Puwedeng magdulot ng problema sa transfer ng title
* Nakakaapekto sa clean status ng property documents

Ano ang dapat gawin?

1. Kunin ang Release of Mortgage / Cancellation of Mortgage Documents

Kapag fully paid ka na, dapat mag-issue ang Bank o PAG-IBIG ng mga sumusunod:

* Release of Real Estate Mortgage
* Cancellation of Mortgage
* Original Title (kung hawak nila)
* Promissory note marked “Paid”
* Other supporting documents

Minsan hindi ito automatic na binibigay, kaya kailangan mong i-follow up.

2. Bayaran ang kinakailangang fees at taxes

May mga documentary stamp taxes, registration fees, at other minimal charges na kailangang bayaran para ma-process ang cancellation.

3. Ipa-register ang Cancellation sa Registry of Deeds

Dalhin ang complete documents sa tamang Registry of Deeds kung saan naka-register ang property.

Kapag approved na:

* Tatanggalin ang annotation ng mortgage
* Maglalabas ng updated title
* Magiging “clean title” na ang status

4. Kumuha ng bagong Certified True Copy

Pagkatapos ma-process, kumuha agad ng bagong kopya ng titulo para ma-check kung wala na talagang encumbrance annotation.

Importanteng Paalala

Maraming homeowners ang akala automatic nang malinis ang title kapag tapos na ang loan — pero hindi ito automatic sa maraming kaso.

Responsibilidad pa rin ng owner na siguraduhing:

✅ Released na ang mortgage
✅ Cancelled na sa Registry of Deeds
✅ Updated na ang titulo

Practical Tip

Kapag fully paid ka na:

* Huwag hayaang tumagal ng maraming taon bago ipa-cancel ang mortgage
* Itago lahat ng receipts at release documents
* Mag-request agad ng updated title copy after cancellation

Dahil kahit bayad ka na, kung naka-encumbered pa rin sa records, puwede ka pa ring magkaroon ng aberya sa future transactions.
