Lesson: Donโt Be Fooled by โAffordableโ Tax Dec Lots
Today someone called me to sell a property in Consolacion.
She bought a small โYuta Yuta / Data Dataโ lot (100 sqm cut) and now wants to resell it.
Here is the problem:
The property has no title, only Tax Declaration (tax dec). She even built a house on it, but now itโs almost impossible to sell at a good price because serious buyers and banks look for a TCT/OCT (title), not just a tax dec.
Why Tax Dec Lots Are Dangerous:
Many โaffordableโ subdivisions cut land into 100 sqm lots and tell buyers:
**** โTax dec lang sa karon, but in 5 years maโtitle na.โ ***
Most of the time, that promise never happens.
Important facts:
1. A Tax Declaration is for real property tax purposes only (assessment for amilyar), not proof that you legally own the land.
2. The Supreme Court has ruled many times that tax declarations and tax receipts are not conclusive evidence of ownership; they only show someone is claiming and paying tax on a property.
3. Because of this, you can have multiple tax decs over the same area and still no clear, clean ownership.
Result: when you want to resell, buyers will hesitate, banks will not accept it as collateral, and you can be exposed to disputes from the true titled owner or other claimants.
**** The Hidden Cost of โCheapโ 100 sqm Lots ****
What usually happens in these cases:
1. You think you got a cheap deal because the monthly amortization is small. You build a house or improvement on a lot that has no clear title.
2. You build a house or improvement on a lot that has no clear title.
3. After a few years, you want to upgrade, migrate, or sell, and suddenly you realize:
*** Itโs hard to resell,
*** You canโt borrow against it,
*** You are not fully protected by law if a dispute comes up.
The โcheapโ lot becomes very expensive when you canโt liquidate or protect it.
My Advice: Donโt Be a Victim -
If someone offers you a 100 sqm โaffordableโ lot with Tax Dec only and promises โTitle in 5 yearsโ:
*** Ask: Where is the mother title? Is the land already titled and just pending subdivision, or is it still public land / untitled?
*** Verify with:
Assessorโs Office โ to see the tax declaration history and who is really assessed as owner.
Registry of Deeds โ to check if there is an existing title and in whose name.
If they cannot show a clear path to a Torrens Title, walk away.
Remember: Tax Dec is NOT 100% proof of ownership. It is only evidence that someone is declaring and paying taxes on the land, not that they legally own it.
Final Reminder to All Buyers
Before you pay for any lot:
1. Look for a proper title (OCT/TCT) or at least a clear, documented process to title the land.
2. Work with licensed brokers and lawyers who can guide you on due diligence.
3. Donโt let โmuraโ or โaffordableโ fool you into buying a problem.
If you are planning to build a home for your family or an investment for your future, make sure it stands on titled land, not just a tax dec and a promise.
