جنرل قمر جاوید باجوہ کی بطور آرمی چیف مدتِ ملازمت میں توسیع اور اس کے اثرات

19 اگست 2019 کو پاکستان کی سیاسی اور عسکری تاریخ میں ایک اہم فیصلہ سامنے آیا، جب اُس وقت کے وزیراعظم پاکستان عمران خان کی حکومت نے جنرل قمر جاوید باجوہ کی بطور چیف آف آرمی اسٹاف مدتِ ملازمت میں مزید تین سال کی توسیع کا اعلان کیا۔ وزیراعظم آفس سے جاری اعلامیے میں اس فیصلے کی بنیادی وجہ "علاقائی سکیورٹی کی صورتحال" (Regional Security Environment) قرار دی گئی۔ حکومت کا مؤقف تھا کہ خطے میں پیدا ہونے والے سکیورٹی چیلنجز کے باعث فوجی قیادت میں تسلسل اور استحکام قومی مفاد میں ہے۔

جنرل قمر جاوید باجوہ نے نومبر 2016 میں چیف آف آرمی اسٹاف کا منصب سنبھالا تھا اور ان کی معمول کی مدتِ ملازمت نومبر 2019 میں مکمل ہونا تھی۔ وزیراعظم عمران خان کی جانب سے اگست 2019 میں کیے گئے فیصلے کے تحت انہیں مزید تین سال کے لیے اسی منصب پر برقرار رکھنے کا اعلان کیا گیا۔ اس وقت حکومت نے اس فیصلے کو ملکی دفاع، خطے کی بدلتی ہوئی صورتحال اور قومی سلامتی کے تقاضوں سے جوڑا۔

تاہم یہ فیصلہ جلد ہی ایک بڑے قانونی اور آئینی معاملے میں تبدیل ہوگیا۔ جنرل باجوہ کی توسیع کو سپریم کورٹ میں چیلنج کیا گیا۔ عدالتِ عظمیٰ نے نومبر 2019 میں قرار دیا کہ آئین اور متعلقہ قوانین میں آرمی چیف کی مدتِ ملازمت میں توسیع یا دوبارہ تقرری کے حوالے سے واضح قانونی طریقۂ کار موجود نہیں تھا۔ سپریم کورٹ نے فوری طور پر ادارے کے تسلسل کو مدنظر رکھتے ہوئے جنرل باجوہ کو چھ ماہ تک عہدے پر برقرار رہنے کی اجازت دی اور پارلیمنٹ کو ہدایت کی کہ آرمی چیف کی مدت، توسیع اور دوبارہ تقرری کے معاملے کو باقاعدہ قانون کے ذریعے واضح کیا جائے۔

اس عدالتی فیصلے کے بعد حکومت نے پارلیمنٹ سے قانون سازی کا راستہ اختیار کیا۔ جنوری 2020 میں پاکستان آرمی ایکٹ میں ترمیم کی گئی، جس کے ذریعے آرمی چیف سمیت سروسز چیفس کی تقرری، دوبارہ تقرری اور مدتِ ملازمت میں توسیع کے حوالے سے قانونی فریم ورک فراہم کیا گیا۔ اس طرح اگست 2019 میں وزیراعظم عمران خان کی طرف سے کیے گئے ابتدائی فیصلے کو بعد ازاں پارلیمانی قانون سازی کے ذریعے قانونی بنیاد فراہم کی گئی۔

اس فیصلے کے بعد کیا اثرات مرتب ہوئے؟

جنرل باجوہ کی مدتِ ملازمت میں توسیع نے پاکستان کی سیاست اور آئینی تاریخ پر گہرے اثرات مرتب کیے۔ سب سے اہم اثر یہ تھا کہ آرمی چیف کی مدتِ ملازمت اور توسیع کا معاملہ پہلی مرتبہ اتنی شدت کے ساتھ عدالتِ عظمیٰ کے سامنے آیا اور اس کے نتیجے میں پارلیمنٹ کو قانون سازی کرنا پڑی۔ سپریم کورٹ نے واضح کیا کہ کسی اہم ریاستی عہدے کی مدت اور شرائط محض روایت یا انتظامی طریقۂ کار کے بجائے واضح قانونی بنیاد پر ہونی چاہئیں۔

دوسرا اہم اثر یہ ہوا کہ اس معاملے نے پاکستان میں اداروں کے درمیان اختیارات، آئین کی بالادستی اور پارلیمنٹ کے کردار پر ایک وسیع بحث کو جنم دیا۔ حکومت، پارلیمنٹ، عدلیہ اور عسکری اداروں کے باہمی تعلقات کے حوالے سے یہ معاملہ ایک اہم آئینی مثال بن گیا۔

تیسرا اثر یہ تھا کہ حکومت اور اپوزیشن، شدید سیاسی اختلافات کے باوجود، آرمی ایکٹ میں ترمیم کے معاملے پر ایک نکتے پر متفق ہوئیں۔ جنوری 2020 میں قانون سازی کے ذریعے مستقبل میں سروسز چیفس کی مدتِ ملازمت اور توسیع کے لیے ایک واضح قانونی طریقہ متعین کیا گیا۔

البتہ اس فیصلے کے سیاسی اثرات صرف قانونی سطح تک محدود نہیں رہے۔ بعد کے برسوں میں جنرل باجوہ کی توسیع کو پاکستان کی سیاسی تاریخ کے اہم فیصلوں میں شمار کیا گیا اور اس پر مختلف سیاسی حلقوں کی جانب سے حمایت اور تنقید دونوں سامنے آئیں۔ بعض سیاسی رہنماؤں نے بعد میں اس توسیع کو سیاسی طور پر ایک غلط فیصلہ قرار دیا، جبکہ اس وقت حکومت کی جانب سے اسے قومی سلامتی اور خطے کی صورتحال کے تناظر میں ضروری قرار دیا گیا تھا۔

نتیجہ

19 اگست 2019 کا فیصلہ بلاشبہ پاکستان کی سیاسی، آئینی اور عسکری تاریخ کا ایک اہم موڑ تھا۔ یہ فیصلہ اُس وقت کے وزیراعظم عمران خان نے اپنی حکومت کی جانب سے جنرل قمر جاوید باجوہ کو مزید تین سال کے لیے آرمی چیف برقرار رکھنے کے لیے کیا، لیکن بعد میں یہ معاملہ عدلیہ کے سامنے پہنچا اور بالآخر پارلیمنٹ کو قانون سازی کرنا پڑی۔

یوں ایک انتظامی فیصلے کے طور پر شروع ہونے والا معاملہ پاکستان میں آئینی تشریح، پارلیمانی قانون سازی، ادارہ جاتی اختیارات اور سویلین و عسکری تعلقات کے حوالے سے ایک بڑی قومی بحث میں تبدیل ہوگیا۔ اس واقعے کا سب سے نمایاں نتیجہ یہی تھا کہ آرمی چیف کی مدتِ ملازمت اور توسیع کے معاملے کو بعد ازاں واضح قانونی شکل دی گئی، جس نے مستقبل کے لیے ایک نیا قانونی راستہ متعین کیا۔

📜 وراثتی انتقال کروانے کا مکمل اور آسان طریقہ کار

کسی شخص کے انتقال کے بعد اس کی ملکیتی جائیداد کو اس کے قانونی و شرعی وارثان کے نام منتقل کروانے کے لیے وراثتی انتقال کا اندراج ضروری ہے۔ بروقت وراثتی انتقال نہ کروانے کی صورت میں مستقبل میں جائیداد کی تقسیم، فروخت یا دیگر معاملات میں پیچیدگیاں اور تنازعات پیدا ہو سکتے ہیں۔

🔹 1۔ ڈیتھ سرٹیفکیٹ حاصل کریں

متوفی کے وارثان میں سے کوئی بھی وارث متعلقہ یونین کونسل/متعلقہ اتھارٹی سے متوفی کا ڈیتھ سرٹیفکیٹ حاصل کرے گا۔

🔹 2۔ نادرا سے FRC حاصل کریں
نادرا سے متوفی کا Family Registration Certificate (FRC) حاصل کیا جائے، تاکہ خاندان اور ممکنہ وارثان کی تفصیل سامنے آ سکے۔

🔹 3۔ بیانِ حلفی اور نمبردار کی تصدیق

وراثتی انتقال کے لیے:
کسی ایک وارث کی طرف سے بیانِ حلفی تیار کیا جائے گا۔
متعلقہ گاؤں کے نمبردار کی طرف سے بھی بیان/تصدیق دی جائے گی۔
دونوں میں تمام زندہ قانونی وارثان کی مکمل اور درست تفصیل درج ہونا ضروری ہے۔

🔹 4۔ درخواست اور دستاویزات جمع کروانا

اگر موضع/چک مینوئل ہو تو وراثتی انتقال کے اندراج و منظوری کے لیے درخواست تحصیلدار صاحب کے دفتر میں، جبکہ آن لائن ریکارڈ کی صورت میں متعلقہ ADLR کے دفتر میں جمع کروائی جائے گی۔
درخواست کے ساتھ عموماً:

🔹 5۔ پٹواری حلقہ کی طرف سے تصدیق اور شجرہ نسب
متعلقہ افسر درخواست مارک کرکے پٹواری حلقہ کو بھجوائے گا۔ پٹواری حلقہ دستاویزات کی جانچ کے بعد وارثان سے رابطہ کرے گا اور موقع پر نمبردار اور پتی دار کی موجودگی میں وارثان کی تصدیق کرے گا۔
اس کے بعد پٹواری حلقہ تمام قانونی وارثان کو شامل کرتے ہوئے شجرہ نسبِ وارثان تیار کرے گا اور اپنی رپورٹ مرتب کرے گا، جس کی حسبِ ضابطہ متعلقہ گرداور اور تحصیلدار سے تصدیق ہوگی۔

🔹 6۔ انتقال کا اندراج اور اخبار میں اشتہار

شجرہ نسب اور وارثان کی تصدیق مکمل ہونے کے بعد وراثتی انتقال کا اندراج کیا جائے گا۔
اس کے بعد متعلقہ تحصیلدار/ADLR کی عدالت کی طرف سے حسبِ ضابطہ اخبار میں اشتہار شائع کروایا جائے گا، جس میں متوفی کے درج شدہ وارثان کی تفصیل دی جاتی ہے اور عوام کو آگاہ کیا جاتا ہے کہ اگر کسی شخص کو کسی وارث کے رہ جانے یا کسی دیگر قانونی اعتراض کے بارے میں کوئی دعویٰ یا عذر ہو تو مقررہ مدت، مثلاً 15 یوم کے اندر بمعہ ثبوت اپنا اعتراض پیش کرے۔

🔹 7۔ عدالت میں حاضری اور شجرہ نسب کی تصدیق

مقررہ کارروائی کے دوران متعلقہ تحصیلدار/ADLR کی عدالت میں کسی ایک وارث کی حاضری بھی ضروری ہو سکتی ہے۔
نمبردار اور ایک گواہ، مثلاً پتی دار، شجرہ نسبِ وارثان اور وارثان کی شناخت/تصدیق کریں گے۔

🔹 8۔ شرعی و قانونی حصص کے مطابق انتقال کی منظوری

تمام قانونی تقاضے مکمل ہونے اور کسی قابلِ سماعت اعتراض کی عدم موجودگی کی صورت میں متعلقہ تحصیلدار/ADLR قانون اور قابلِ اطلاق شرعی اصولوں کے مطابق تمام وارثان کے حصص کا تعین کرتے ہوئے وراثتی انتقال منظور کرے گا۔

⚠️ اہم بات
وراثتی انتقال میں سب سے اہم مرحلہ تمام قانونی وارثان کی درست نشاندہی ہے۔ کسی ایک وارث کو جان بوجھ کر چھپانا یا شجرہ نسب میں غلط معلومات درج کروانا مستقبل میں سنگین قانونی تنازع کا سبب بن سکتا ہے۔
یہ بھی یاد رکھیں کہ دستاویزات، اشتہار، حاضری اور دیگر کارروائی کا طریقہ کار موضع کے ریکارڈ کی نوعیت اور متعلقہ صوبائی/ریونیو قوانین کے مطابق مختلف ہو سکتا ہے۔ اس لیے عملی کارروائی شروع کرنے سے پہلے متعلقہ ریونیو آفس سے موجودہ طریقہ کار کی تصدیق ضرور کر لیں۔

The Juvenile Justice System Act 2018 classifies offences into three categories: minor, major, and heinous. Section 6(3) states that where a juvenile is arrested or detained for the commission of a minor or a major offence, he shall be treated as if he was accused of commission of a bailable offence. Section 6(4) provides that where a juvenile above the age of sixteen is arrested or detained for a heinous offence, the Juvenile Court may withhold bail if it finds reasonable grounds to believe that he is involved in its commission. In contrast, section 6(5) stipulates that any juvenile, regardless of age, who has been detained for a continuous period exceeding six months without conclusion of trial shall be released on bail, unless the delay is attributable to the juvenile himself. In Mehran, the Supreme Court ruled that while section 6(4) deals with the matter of bail on merits, section 6(5) provides a distinct statutory ground for bail based solely on delay. Since minor and major offences are treated as bailable under section 6(3), the rigour of section 6(5) applies only to juveniles accused of heinous offences. The Supreme Court further held that a juvenile detained for a heinous offence is entitled to post-arrest bail as of right, whether below or above sixteen years of age, if the requirements of section 6(5) are met.

Although it is true that the occurrence of this case is very shocking and brutal but at the sametime, it is also duty of this Court to do justice and to see that as to whether the prosecution has proved its case against the accused beyond the shadow of any doubt in order to ensure that a person,who may be innocent, may not be hanged to death, in absence ofreliable evidence against him or a culprit against whom the case hasbeen proved by the prosecution beyond reasonable doubt may notgo unpunished.

The injuries on the body of an injured eye-witness are not aproof of his credibility and truth.

Non-adverse party---Cross-examination, right of---Dispute was with regard to deleting cross-examination conducted by petitioner/defendant on a witness produced by respondent/co-defendant on the plea that both were not adverse parties---Validity---Only such party, which had obvious conflict of interest, could enjoy right of cross-examining witness of opponent parties---In the present case, interest of petitioner/defendant and that of respondent/co-defendant was the same and there was no conflict of interest between them, thus an opportunity of cross-examination to witnesses of respondent/co-defendant having no adverse interest to each other could not be given in order to prevent abuse of process of law as well as to prevent filling up lacunas occurring in the statement of witness through the sword of cross-examination---Lower Appellate Court did not commit any illegality in exercise of revisional jurisdiction---

JUDGMENT

.---Through this petition under Article 199 of the Constitution of the Islamic Republic of Pakistan, 1973, the petitioner has challenged the validity of judgment dated 12.11.2022 passed by the learned Additional District Judge, Lahore who accepted the revision petition of respondents Nos.1 and 2/plaintiffs, set aside the order dated 07.04.2022 passed by the learned Civil Judge, Lahore and struck off cross-examination conducted upon DW3 to DW5 by the learned counsel for the petitioner as well as respondent No. 4.

2. Brief facts of the case are that Arfeen Ejaz etc. respondents Nos.1 and 2/plaintiffs filed a suit for declaration with permanent injunction against the petitioner and respondents Nos.3 to 6/defendants in respect of plot No.12-C, Gulshan Ravi Scheme, Lahore with the claim that the above said plot was owned by three brothers namely, Ijaz Ali (father of the plaintiffs), Mumtaz Ali/defendant No.1 and Nawazish Ali (died issueless) and a suit for declaration was instituted for declaration of legal heirs. The said suit was decreed by declaring Razia a Sultana, Safia Sultana, Bushra Parveen and Shahnaz Parveen as well as the father of the plaintiffs and respondent No.3/defendant No.1 as legal heirs of the deceased and accordingly the property was devolved upon all the legal heirs as per their respective shares; that Mst. Razia Sultana, Safia Sultana, Bushra Perveen and Shahnaz Perveen (sisters of the deceased) transferred their shares in favour of Ijaz Ali, father of the plaintiffs and Mumtaz Ali/defendant No.1 through registered sale deed No.6616 dated 11.08.1998, thus the above said Ijaz Ali and Mumtaz Ali became exclusive owners of the suit property. In the year 2003, Mumtaz Ali/respondent No. 3 sold his share in favour of Ijaz Ali (father of respondents Nos.1 and 2) and accordingly transfer letter dated 09.05.2003 was issued by the LDA in favour of Ijaz Ali. In 2005, said Ijaz Ali transferred the suit property/plot in question in favour of (respondents Nos. 1 and 2) and this transfer was incorporated the record of LDA (respondents Nos. 5 and 6/defendants Nos. 4 and 5) through transfer letter dated 28.07.2005 and respondents Nos. 1 and 2 became owners of the suit property.

That Mumtaz Ali, the father of respondent No.3/defendant No.1 submitted his undertaking that he had no concern with the suit property as he has transferred his share in favour of Ijaz Ali (father of respondents Nos. 1 and 2).

That Imtiaz Ali, respondent No.3/defendant No.1 allegedly executed general power of attorney dated 20.02.2007 in favour of Muhammad Ramzan who by using the said power of attorney transferred a portion of the suit property in favour of his son, Muhammad Umar Ramzan through registered sale deed No.5037 dated 27.09.2007. Respondents Nos. 1 and 2/plaintiffs challenged the said general power of attorney as well as registered sale deed in favour of the petitioner through civil suit which was contested by the petitioner through filing a written statement. As per respective divergent pleadings of the contesting parties, the learned trial court framed issues. The plaintiff adduced their evidence and similarly the petitioner/defendant No.2 had also got recorded statements of DW-2 to DW-5; that the learned counsel for the petitioner/defendant started cross-examination of the witnesses (DWs) of the co-defendants. Plaintiff/respondents Nos. 1 and 2 filed objection that a co-defendant having shared common interest is debarred to conduct cross-examination on the witness of other co-defendants as it is amounted to filling up the lacunas. The said objection petition was contested by the petitioner/defendant No.3 and the learned trial court vide order dated 07.04.2022 rejected the said objection petition. Respondents Nos.1 and 2 challenged the said order through revision petition which was accepted by the learned revisional court who vide judgment dated 12.11.2022, set aside the above said order of the learned trial court and struck off the cross-examination conducted on DWs by the petitioner/defendant No.3 from the record. Hence, this writ petition.

3. I have heard the arguments advanced by the learned counsel for the parties at full length and gone through the entire record with their assistance.

Admittedly the petitioner is son of Muhammad Ramzan/ respondent No.4 who (defendant No.4) on the basis of alleged general power of attorney executed by Mumtaz Ali, respondent No.3/defendant No.1 transferred the portion of the suit property in favour of his real son/petitioner. The stance of respondents Nos. 1 and 2/plaintiff is that petitioner and respondent No.4 (defendant) have common interest and are not adverse to each other, as such the witnesses (DW2 to DW-4) were produced by respondent No.4 to prove his version which is amounted to prove the stance of petitioner/defendant No.3. Though different counsel filed written statements which are same ditto copies of each other. The main point before this Court is whether the non-adverse parties having common/joint interest may cross-examine the witness of each other or otherwise. Article 132 of Qanun-e-Shahadat Order 1984 relates to examination-in-chief etc. of a witness of a party. The initial statement of a witness with regard to the matter in issue is called his examination-in-chief and the examination of a witness by the adverse party is called his cross-examination. As per Sub-Article (1) of Article 132 of the Order ibid, witnesses shall be first examined-in-chief, then (if the adverse party so desires) cross-examine him, then (if the party calling him so desires) re-examines the witness. For ready reference, Articles 132 and 133 of Order 1984 are reproduced as under:-

"132. Examination-in-chief, etc.---(1) The examination of a witness by the party who calls him shall be called his examination-in-chief.

(2) The examination of a witness by the adverse party shall be called his cross-examination.

(3) The examination of a witness, subsequent to the cross-examination by the party who called him, shall be called his re­examination.

(emphasis supplied)

133. Order of examinations.---(1) Witnesses shall be first examined-in-chief, then (if the adverse party so desires) cross-examined then (if the party calling him so desires) re-examined.

(2) The examination and cross-examination must relate to relevant facts but the cross-examination need not be confined to the facts to which the witness testified on his examination-in-chief.

(3) The re-examination shall be directed to the explanation of matters referred to in cross-examination, and, if new matter is, by permission of the Court, introduced in re-examination, the adverse party may further cross-examine that matter."

The word "Adverse party" has garnered a material significance and as this word is not defined in the very ordinance ibid, thus its plain ordinary meaning is to be imported/borrowed from Dictionary. In Black's Law Dictionary "Adverse party" is defined as under:-

"Adverse party. A party whose interests are opposed to the interests of another party to the action."

Thus, as per the above meaning of word, only such a party which has obvious conflict of the interest can enjoy the right of cross-examining the witness of the opponent parties. As per available record, pleading, the interest of the petitioner and that of respondent No.4 (defendants Nos.2 and 3) being father and son is quite common/one and the same. Respondent No.4 being father transferred the property in favour of his son on the basis of alleged general power of attorney and the witnesses of the father/defendant No.2 took same stance as taken by the petitioner/defendant No.3 as such the petitioner's case does not fall adverse to interest of his father, thus the petitioner cannot be allowed to cross-examine the witnesses of his father. Reliance is placed on a case titled as Barkat Ali v. Additional District Judge Dadyal and 4 others (2022 YLR 868) wherein it is held as under:-

"Article 132(2) of Qanun-e-Shahadat Order, 1984 postulates that examination of a witness by the adverse party is cross-examination. Article 133(1) of Qanun-e-Shahadat refers to cross-examination if the adverse party so desire after the witness is first examined in chief. These two provisions of Qanun-e­Shahadat Order make it clear that a party has a right of cross-examination if feels adversely affected. As a general rule, evidence is not legally admissible against a party who at the time it was given, had no opportunity to cross-examine the witness who recorded such evidence. It is now well settled principle of law that no evidence should be read against one who was not given opportunity of testing it by cross-examination. On the basis of same principle, it would be unjust, unfair and unsafe not to allow a co-defendant to cross-examine a witness called by the other co-defendant whose case was adverse to him, produce evidence which incriminates other defendants, thus later have a right to cross-examine those witnesses. If there is no conflict of interest, then such an opportunity needs not to be given. Therefore, the condition precedent for giving an opportunity to a co-defendant to cross-examine the other co-defendant is, that there should exist conflict of interest between them either from the pleadings or during the course of evidence. Once it is demonstrated that their interests are not common or there is a conflict of interest and evidence has been adduced affecting the interest of co-defendant then the Court cannot rely on that evidence without giving the opportunity of cross-examination to the party affected by it. The person against whom the evidence is given should have opportunity to cross-examine the said witness, so that ultimately, truth may emerge, on the basis of which the Court can decide the matter....."

Reliance is also placed on the case cited as Muhammad Imran Khan and 4 others v. Haji Muhammad Akhtar and others (PLD 2021 Sindh 510) and Sadhu Singh v. Sant Narain Singh Sewadar and others (AIR 1978 Punjab and Haryana 319).

As the interest of the petitioner and that of respondent No.4 is the same and there is no conflict of interest between them, thus an opportunity of cross-examination to the witnesses of co­-defendant having no adverse interest to each other could not be given in order to prevent the abuse of process of law as well as to prevent filling up the lacunas occurred in the statement of the witness through the sword of cross-examination. Resultantly the learned revisional court has rightly accepted the revision petition of respondents Nos.1 and 2/plaintiffs and has committed no illegality.

It evinces from the record that the instant Constitutional petition arises from the judgment passed by the learned Revisional Court and ordinarily, this Court avoids to interfere with such Revisional orders in its constitutional jurisdiction unless the same is found to be patently illegal and without jurisdiction. Reliance is placed on a case titled as Muhammad Khan and 6 others v. Mst. Ghulam Fatima and 12 others (1991 SCMR 970) held as under:-

"The learned High Court observed that a revisional order arising out of civil litigation could not be challenged in the Writ Petition and relied upon Ghulam Hussain v. Malik Shahbaz Khan 1985 SCMR 1925; Muhammad Bakhsh v. Ghulam Hussain 1989 SCMR. 443 and Muhammad Zahoor v. Lal Muhammad 1988 SCMR 322."

7. Learned counsel for the petitioner has neither pointed out any illegality, material irregularity while passing the impugned judgment nor identified any jurisdictional defect calling for interference by this Court.

8. In view of above, this writ petition is dismissed being devoid of any merits.

*پاکستان میں 32 نئے صوبے اور 33 ہائی کورٹس بنانے کی تجویز، پریزنٹیشن تیار، میڈیا رپورٹس*

*مجوزہ منصوبے کے تحت پنجاب میں 10، سندھ میں 7، خیبر پختونخوا میں 7 اور بلوچستان میں 8 نئے صوبے قائم کیے جائیں گے۔40 ہزار سےزائد سرکاری آسامیاں ختم کرنے کی سفارش*

*اسلام آباد: پاکستان میں انتظامی بہتری اور وسائل کی منصفانہ تقسیم کے لیے 32 نئے صوبے بنانے کا ایک تفصیلی خاکہ اور پریزنٹیشن تیار کر لی گئی ہے۔ اس تجویز کے مطابق ملک کو مجموعی طور پر 33 انتظامی اکائیوں (Federating Units) میں تقسیم کیا جائے گا، جس میں اسلام آباد بطور وفاقی دارالحکومت برقرار رہے گا جبکہ چاروں صوبوں کی ڈویژنز کو صوبوں کا درجہ دیا جائے گا*

*مجوزہ منصوبے کے تحت پنجاب میں 10، سندھ میں 7، خیبر پختونخوا میں 7 اور بلوچستان میں 8 نئے صوبے قائم کیے جائیں گے۔ اس نئی تقسیم کے بعد ملک میں 33 ہائی کورٹس قائم ہوں گی جن میں مجموعی طور پر 137 ججز فرائض انجام دیں گے*

*دستاویزات کے مطابق اس اہم انتظامی تبدیلی سے قومی خزانے کو سالانہ 318 ارب روپے کی بچت کا تخمینہ لگایا گیا ہے۔ یہ بچت 40 ہزار سے زائد غیر ضروری انتظامی آسامیوں کے خاتمے سے ممکن ہوگی، جبکہ عدلیہ کا موجودہ 56 ارب روپے کا بجٹ کم ہو کر 24 ارب روپے رہ جائے گا۔ نئے نظام میں تعلیم، صحت اور فنانس سمیت 40 سے زائد محکمے مکمل طور پر صوبوں کو منتقل ہو جائیں گے*

*قومی و صوبائی اسمبلی کے ارکان کی کل تعداد وہی رہے گی، تاہم وہ آبادی کے تناسب سے اپنی چھوٹی صوبائی اسمبلیوں میں تقسیم ہو جائیں گے*

*33 نئے وزرائے اعلیٰ بننے سے چند مخصوص سیاسی خاندانوں کی اجارہ داری ختم ہوگی اور مقامی سطح پر نئی سیاسی قیادت ابھر کر سامنے آئے گی*

*پریزنٹیشن میں یہ دلائل دیے گئے ہیں کہ پاکستان کے موجودہ چاروں صوبے آبادی اور رقبے کے لحاظ سے دنیا کے کئی ممالک، حتیٰ کہ چین اور بھارت کے صوبوں سے بھی بڑے ہیں*

*2.5 کروڑ بچے سکولوں سے باہر ہیں، 40 فیصد بچے غذائی قلت کا شکار ہیں، اور پاکستان انسانی ترقی کے انڈیکس میں 193 میں سے 168ویں نمبر پر ہے ۔ چھوٹے انتظامی یونٹس بننے سے وسائل نچلی سطح تک پہنچیں گے اور طرزِ حکمرانی بہتر ہوگا*

*پریزنٹیشن میں یہ مؤقف اختیار کیا گیا ہے کہ موجودہ صوبے رقبے اور آبادی کے لحاظ سے بہت بڑے ہیں، جس کی وجہ سے گورننس میں مشکلات درپیش ہیں۔ چھوٹے انتظامی یونٹس بننے سے نہ صرف مخصوص خاندانوں کی سیاسی اجارہ داری ختم ہو گی بلکہ مقامی سطح پر نئی قیادت بھی ابھرے گی*

*دوسری جانب سیاسی اور قانونی ماہرین کا کہنا ہے کہ نئے صوبوں کے قیام کے لیے آئین میں بھاری ترمیم درکار ہو گی، جو موجودہ طریقہ کار کے تحت انتہائی مشکل عمل ہے اور اس حوالے سے قومی سطح پر وسیع اتفاقِ رائے پیدا کرنا ہو گا۔ جس کے لیے بیانیہ بنانا اور رائے خاصہ ہموار کرنے کی کاوشیں شروع کر دی گئی ہیں*
