VAT on construction: reduction to 6% comes into force, but the rules are already set to change

From 1 July 2026, the reduction in the VAT rate from 23% to 6% on residential construction will come into force, a government measure aimed at boosting the supply of homes on the market.

However, just a few days before it is due to be implemented, new changes are emerging. After the Tax Authority clarified the rules for applying the new rate, the Government has tabled a draft bill aimed at simplifying the scheme by amending one of its most significant aspects: the method of VAT settlement.

The intention is for the reverse charge mechanism to apply to all purchasers of construction services, and not just those entitled to a VAT deduction, as currently provided for by law.

It should be noted that the application of the reduced rate remains subject to compliance with various requirements, namely:
✔️ Property intended for permanent residence;
✔️ A sale price of up to €660,000 or a monthly rent of up to €2,300;
✔️ Compliance with the other conditions laid down by law.

Although the measure has come into force, the legal framework continues to evolve; therefore, developers, builders and investors should closely monitor forthcoming changes to ensure full compliance with the new rules.
