What’s new in the 2024 Local Accommodation Regulations?

A Return to Licensing Opportunities: Local councils now have more control over issuing AL licenses, allowing for greater flexibility based on regional needs. This opens up new possibilities for owners looking to benefit from AL.

AL Licenses with No Expiration Date: AL licenses are now permanent, giving owners greater security and eliminating the need for periodic reassessments. This change allows you to plan confidently for the long term.

Rising Demand and Emerging Opportunities:
Navigating the Algarve Property Market

According to research by Remax, the Algarve remains a popular destination for both national and international property buyers. During the first seven months of the year, the region saw a remarkable 85% increase in demand for housing in July, compared to the last quarter of 2023. The most sought-after areas are in the western Algarve, with Portimão, Loulé, and Albufeira leading in demand.

Portimão tops the list as the most popular municipality with 19.3% of the demand, followed by Loulé at 15.4%, and Albufeira at 14.3%. The demand in Faro and Tavira also remains strong. Conversely, areas like Monchique and São Brás de Alportel experience lower demand, primarily due to their lack of direct access to the sea and beaches.

The data further highlights a preference for smaller apartments, especially T0 to T2 types, with T1 apartments in Loulé and Faro witnessing the highest demand. Beatriz Rubio, CEO of Remax Portugal, emphasizes the Algarve's continued attraction not just as a tourist hotspot but also as a preferred location for permanent residence, thanks to its unique natural environment, high quality of life, and investment opportunities.

From my perspective, as we approach the end of the high season around September/October, we can expect an increase in available properties everywhere in the Algarve, which will provide more options for buyers.

Why Invest in the Algarve Now?

Law No. 35/2024, effective August 7, 2024, introduces major improvements that enhance investment opportunities in the Algarve.

Here’s what you need to know:

1. Revocation of Extraordinary Tax on Local Accommodation
The law repeals the extraordinary contribution on properties used for local accommodation, effective from December 31, 2023. This removal reduces financial burdens and simplifies tax regulations for property owners in the local accommodation sector.

2. Removal of Obsolete Depreciation Coefficient
The outdated depreciation coefficient for local accommodation establishments, used in calculating Municipal Property Tax (IMI), has been revoked. This change, effective from December 31, 2023, provides fairer property valuations for investors.

3. Enhanced Tax Benefits for Geographical Mobility
The law introduces a new IRS deduction for rental expenses for individuals relocating more than 100 km for work. This supports employees and investors who move within Portugal for job opportunities.

4. Reduced Reinvestment Period for Tax Benefits
The reinvestment period for tax advantages is now 12 months, with the period counted from the date of reinvestment. Exceptions are made for changes in family composition and job mobility, making reinvestment strategies more flexible.

5. Simplified Tax Rules for Property Investments
The updated IRS Code reduces bureaucratic hurdles and financial obstacles, creating a more investor-friendly environment in the Algarve.

6. Transferability of Holiday Rental Licenses
The new legislation reintroduces the transferability of holiday rental licenses, reversing the previous non-transferability rule. This change, expected to be finalized soon, allows licenses to be transferred in cases of death, divorce, or inheritance, addressing past restrictions and market deregulation concerns.

7. Decentralization of Local Accommodation Regulations
Future regulations for local accommodation will be decided by municipalities rather than centralized by the government. This decentralization ensures that rules are tailored to local needs and pressures, enhancing the management of local accommodation.
