Yes, the developer is allowed to sell 49% of the total saleable area of the building to foreigners in the form of equity. The remaining 51% must be sold to Thai citizens or Thai companies, with foreign shareholders owning up to 49% of the shares. That's why you'll find different prices or payment terms listed for each development, depending on whether the apartment is sold as "expat property" or "Thai company property."
This applies to condominiums. For houses and villas built on their own private land, foreigners can only buy them in the form of property rights of Thai companies, since it is usually impossible for foreigners to own land in Thailand.
