Never assume family property can be sold by a single individual. For the sale to be legally valid, you must obtain the consent of both the Family Head and principal family members.

In Trinidad and Tobago, land falls under either the Common Law or the Real Property Act (RPA) system. Accordingly, the deeds used depend on your specific transaction and property title. The official documents are recorded through the Registrar General Land Registry. https://agla.gov.tt/registrar-general/registrar-general-land-registry/

Here are the most common types of deeds and instruments used in Trinidad and Tobago:

1. Deeds of Sale & Transfer
➡️Deed of Conveyance: Used under Common Law to transfer the ownership of property from a seller (vendor) to a buyer.
* Memorandum of Transfer (MOT): The RPA system equivalent of a Deed of Conveyance.

2. Deeds of Gift
➡️Deed of Gift: Used to voluntarily transfer property ownership to another person (like a family member) without any monetary exchange under Common Law.
* Memorandum of Gift: The RPA system equivalent of a Deed of Gift.

3. Mortgages
➡️Deed of Mortgage: Used to secure a loan from a bank or financial institution, where the property is used as collateral.
* Memorandum of Mortgage: The RPA equivalent of a Deed of Mortgage.

4.Leases
➡️Deed of Lease / Memorandum of Lease: Used when property is rented or leased for a long or specified period of time (e.g : 99 years plus). State lands are commonly issued under this format.

5. Other Specific Deeds
➡️Deed of Assent: Used to legally transfer the property of a deceased person to the beneficiaries named in their will or through a grant of representation (letters of administration).

➡️Deed of Partition: Used to divide jointly owned property into separate, individual parts.

➡️Deed of Release/Reconveyance: Used to formally release a mortgage once the debt is paid. Used to clear a property title (usually to release the bank's mortgage interest after a loan has been fully paid off).

➡️Deed Poll: A legal deed used to formally change your name or establish a new signature.

➡️Power of Attorney: A legal deed that authorizes another person to act on your behalf regarding real estate or financial transactions.

Why the System Matters
➡️Common Law ("Old Law"): Transfers are governed by the Conveyancing and Law of Property Act,https://www.finance.gov.tt/wp-content/uploads/2019/07/The-Real-Property-Act.pdf and proving ownership requires tracing the "root of title" over decades.

➡️RPA System (Torrens System):Governed by the Real Property Act, where ownership is guaranteed by the state and proven simply by a Certificate of Title.

Not all deeds offer the same level of protection or ownership rights. Understanding the type of deed involved in a property transaction is essential before buying, selling, or transferring property.
