Mortgage loans enjoy the longest statute of limitations as compared to other matters. In VA, it is 10 years after maturity; in MD, it is 12 years. If there is no maturity date, the statute of limitations is 40 years. Does she have a written statement from the lender? It is somewhat unfortunate that she had no other transaction after the subject refinance. If there were, a title company should have discovered the mortgage loan status and resolved it. I hope she has other defenses. Good luck!

An owner's title insurance policy would have covered a bona fide purchaser from the loss if he had purchased the policy. The fraudulent sale should be void as the sales contract was never legally valid from the beginning. The recovery funds have to come from the title insurance company, title agent's E & O insurance, lawyer's malpractice insurance, realtor's insurance, etc. A lesson learned here - is not to try to save money by skipping an owner's title insurance policy. A mistake is a part of human nature! Even when everyone is doing his or her due diligence, this kind of thing happens.
