The Seller can be the Estate and the contract signed by the Executor if there is a Will which gives him/her powers of sale and he/she qualifies in Probate Court or it can be signed by the Devisees under a probated Will.

If there is no Will, the Heirs at Law, as established by a Real Estate Affidavit filed in the Circuit Court where the property is located, can sign the Contract. If there is an Administrator appointed by the Court with the power to sell real property, then the Administrator can sign the contract.

As a real estate agent it is important to be aware of these menacing advertisements and know what has prompted these concerns.

Title Lock insurance commercials are prevalent on television and the radio. However, title lock insurance, does not “lock” your title nor “insure” you against any fraud. At best, the service offered simply informs you that your title has been “stolen” after the fact.

Due to the intimidating nature of these advertisements, the MD Attorney General sent out a Consumer Alert (https://www.marylandattorneygeneral.gov/press/2022/062722CA.pdf).

The Attorney General concluded “[t]he bottom line is: You don’t need to purchase title lock insurance.” As noted in the release, title lock insurance is separate and distinct from title insurance. The MD AG distinguished the two products and noted that that title insurance provides valuable protection to real estate purchasers and lenders from potential losses.

This question provides a wonderful opportunity for you to market yourself and your business acumen if you advised your client to purchase an enhanced title insurance policy. The title policy they have in place provides coverage for the exact type of fraud which is warned of in the commercials!

It is a matter of preference and sometimes the decision is situational (case by case), but there are some practical and legal implications to take into consideration. When you name only yourself (as the agent), you take on the burden and risk of liability in a situation where an email containing a notice escapes you, or you don’t forward it to your client in time to discuss/address/respond in a timely manner. Remember, if you specify yourself for Delivery, then Delivery to you EQUALS Delivery to your client, and all timeframes start to run.

Example: Let’s say a notice is sent to you with requests for repairs under a home inspection contingency. It goes into your spam, or you are on vacation, and you do not see it. You then notice it in your spam, but not until after the negotiation period has expired, making it impossible for your client to respond timely. The buyers are now in their election period and they decide to void the contract due to your client’s lack of response. If the seller were to seek legal recourse for the contract fall through,
liability could become yours given you were the responsible party for receiving the notice.

Alternatively, naming only your client makes it such that you do not see notices until after your client has, which may not be a good way of managing their reactions, delivery of information, and the transaction. However, if you had named you and your client, responsibility is shared and it lessens the liability to the agent in the event a response isn’t timely, but it also ensures you see notices at the same time as your client.

1️⃣ They sell the home within two years of the death of the spouse.
2️⃣ They have not remarried at the time of the sale.
3️⃣ Neither the seller nor their late spouse took the exclusion on another home sold less than two years before the sale of the current home.

They will sign a contract with the seller, and then they will market the property and find an “end buyer” who will ultimately buy the property. They will earn a fee based on the difference between the contract price with the seller and the end buyer, minus any fees they agree to pay under the contract.

The wholesaler is in privity of contract with both the seller and the end buyer, who are not in privity of contract with themselves. A good wholesaler will not only find the seller to sell and the end buyer to buy, but will also facilitate the process of helping both parties get to closing.

Yes, one-half of the amount realized from the sale (generally the “gross proceeds” or sales price) will be subject to withholding under the Foreign Investment in Real Property Tax Act (FIRPTA). It is always a 50-50 split with a married couple regardless of contribution to the purchase or the actual time spent living in the property. The FIRPTA tax will be either 10% or 15% on half of the amount realized.

An unreleased deed of trust is a cloud on title and technically renders the property unmarketable. This is a common title defect usually arising from the current owner’s purchase of the property where the prior owner’s mortgage was paid-off but the deed of trust was not released from the land records.

If the last servicer of that loan is in business, usually a release can be secured within 2 weeks. Older loans are more difficult and take more time. A copy of the seller’s title insurance policy will enable the title insurance company to “insure over” this lien and allow the closing to take place, if the buyers agree, even if the lien release has not been secured by the closing date.
