A recent letter to Governor Gavin Newsom regarding AB 2533 and the need for clearer, consistent health and safety standards in its implementation:
Dear Governor Newsom,
I am a Realtor Emeritus, now beginning my 58th year as a Realtor. Over the decades, I have served on the Board’s Professional Standards Committee and several other committees for our local association. I am currently assisting a client through the process of legalizing an unpermitted ADU under AB 2533. This particular unit has existed and been continuously occupied since 1958—first by grandparents until 2013, and since the passing of the grandmother at age 101, by tenants.
There is considerable confusion among local agencies about how to define “health and safety” in the context of this law. We have been asked to provide extensive details such as foundation specifications, soil reports, and interior wall framing measurements (whether 2x4 or 2x6). The local building department appears concerned that they might be held legally responsible for any health or safety issues that are not explicitly addressed.
I believe it would serve the public best if the health and safety standards for legalization under AB 2533 were consistent with the standards established for Section 8 housing. I have rented to many Section 8 tenants over the years and have found those requirements to be fair, practical, and protective of tenant well-being.
Applying a higher standard to property owners legalizing long-standing units suggests, even if unintentionally, that the health and safety of Section 8 tenants are somehow less important or held to a lower value. Equal standards would reflect an equitable approach—ensuring that all California residents, regardless of income or housing program, are afforded the same level of safety and dignity in their homes.
Establishing a consistent benchmark with Section 8 guidelines would also help streamline the legalization process under AB 2533, reduce confusion among local officials, and provide a clear path to serve the public.
