Little Assumable Loan Storytime for my fellow buyers, sellers & agents 👇
I just went through a situation on a VA assumable that I think is worth sharing because it’s something a lot of agents haven’t experienced yet.
My buyer is assuming a VA loan with the seller’s entitlement staying in place, meaning the property will be used as a rental instead of a primary residence.
This is something that is allowed under VA guidelines, and I’ve done transactions structured this way before without issue.
However, about 35 days into the transaction, the servicing bank suddenly tried to stop the deal. Their reasoning was that they felt it was “too risky” to allow the assumption if the buyer wasn’t using the home as a primary residence.
The problem?
They had nothing in writing stating that policy, and my buyer had already been fully approved to assume the loan.
Instead of letting the deal die halfway through escrow, we started escalating.
• I spoke directly with the bank
• Consulted a real estate attorney
• With permission from the buyer and seller, brought in a third-party (Assumption Solutions) to help escalate the file
For the past two weeks, this has been climbing the ladder.
Underwriting → denied
Management → denied
Escalated to the VA
And today we got the news…
The decision was overturned by the VA and the assumption was approved to move forward!
So if you’ve heard people say that VA assumables can’t be done when the seller leaves their entitlement behind or when it won’t be a primary residence, that’s not entirely accurate.
There can be gray areas, and sometimes lenders push back simply because they don’t see these situations often or they aren’t particularly motivated to process assumable loans.
But the VA does allow these scenarios, and sometimes it just takes the right people advocating for the deal and escalating it when necessary.
Assumables are an incredible opportunity for buyers right now, but they’re also very different from a traditional loan process, which is why having an agent who understands them (and is willing to fight for the deal) really matters.
Just wanted to share this in case anyone else runs into a similar situation.
