📌 Term Tuesday: Sublease vs Assignment

These two terms get confused all the time—but they can impact your liability in a BIG way.

Let’s break it down 👇

👉 Sublease

A sublease is when the original tenant rents out their space to a new tenant—but still keeps the lease.

💡 Key point:
The original tenant is STILL responsible to the landlord.

👉 Assignment

An assignment is when the original tenant transfers their entire lease to a new tenant.

💡 Key point:
The new tenant steps into your shoes—but you may STILL have liability depending on the lease.

🚨 The biggest difference:

• Sublease = You stay on the hook
• Assignment = You transfer the lease (but don’t always escape liability)

🔍 What most people don’t realize:

• Landlord approval is typically required for BOTH
• Assignments often require financial review of the new tenant
• Some leases keep the original tenant liable even after assignment

In simple terms, a TI Allowance is a specific dollar amount (usually calculated per square foot) that a landlord provides to a tenant to cover the cost of renovating or "fitting out" a space.

Why It Matters in 2026:

With construction costs and lead times being a major factor in today’s market, understanding how this money is spent is crucial. It’s not just about the total dollar amount; it’s about the terms.

Things you didn't know about TI Allowance 🛠️

It’s Amortized: The landlord isn't giving you a gift; they are baking that cost into your rent over the life of the lease.

Use it or Lose it: Most leases have an expiration date on when you can claim these funds. If you don't use the full amount by a certain date, the landlord keeps the change!

The "Surrender" Clause: Check if you have to remove those expensive upgrades when you move out.
