Quick estate reminder:
A Personal Representative can only convey a PR Deed—not a warranty deed.
Why?
Because the PR is acting on behalf of the estate and can’t make personal guarantees about the property’s history.

This is totally normal in probate sales, but it’s something buyers and agents should expect so there are no last‑minute surprises.
Knowledge upfront = smoother closings every time.

Ever wonder what the difference is between a Warranty Deed and a Quitclaim Deed with Covenant?
Here’s the quick breakdown ⬇️
✅ Warranty Deed
Provides the highest level of protection. The seller guarantees clear title back to the beginning of time and agrees to defend it if a claim ever comes up.
✅ Quitclaim Deed with Covenant (most common in Maine)
The seller promises they haven’t done anything to hurt the title during their ownership—but does not guarantee issues from before they owned the property.
So why is a quitclaim with covenant so widely accepted?
👉 Title insurance helps bridge the gap.
Even without full historical guarantees, title insurance protects buyers and lenders from unknown defects, old liens, recording errors, missing heirs, and other covered defects.
Bottom line:
In Maine, a quitclaim deed with covenant + title insurance is a perfectly normal—and smart—way to transfer property.

Not all deeds are created equal—especially here in Maine.
A quick refresher:
✅ Warranty Deed – Highest level of protection
✅ Quitclaim Deed with Covenant - Seller promises they have not done anything to harm title while they have owned the property. Makes no guarantees about title issues that existed before the seller owned the property.
✅ Quitclaim Deed – Conveys only whatever interest the grantor has
✅ PR Deed – Used in estates and can only convey what the estate owns
Understanding which deed is being used helps avoid confusion (and surprises) at closing. When questions come up, title is always a great place to start!
