Florida construction liens can derail a closing fast.

Even when title looks clean, Chapter 713 risks may still be sitting in the background—especially after recent repairs, renovations, or contractor work.

For title professionals, that means one thing: don’t rely on the surface.

Watch for:
• Open Notices of Commencement
• Missing lien releases
• Unpaid subs or suppliers
• Recent work that may still carry lien rights

⚠️ Important Update for Title Professionals — FinCEN Rule

A federal judge in the Eastern District of Texas has vacated the FinCEN Residential Real Estate reporting rule (31 C.F.R. § 1031.320), making it currently unenforceable.

However — an appeal is expected immediately. This same court previously paused the Corporate Transparency Act, which was reinstated within weeks. We anticipate a similar outcome here.

Our recommendation in the meantime:
✅ Continue initiating FinCEN reports as usual
✅ Move open files to Clear to Close
✅ Hold off on confirming closings until the rule is reinstated

Reports are only billed once marked as closed — so there's no additional cost to maintaining your workflow during this pause.

We'll continue monitoring developments and will provide updates as they unfold.
