Federal Court Addresses Section 42 and LIHTC Award Disputes

On September 4, the U.S. District Court of Guam issued a ruling in Summer Vista II DE, LLC v. Rivera et al., a case involving a developer's challenge to a LIHTC award made under Guam's 2025 Qualified Allocation Plan.

The court held that Section 42 of the Internal Revenue Code does not create a private right of action for developers to challenge allocating agency decisions in federal court. The opinion noted that Section 42 includes its own compliance and enforcement structure through allocating agencies and the IRS. The ruling is consistent with earlier federal decisions in Indiana, Washington, Florida, and Michigan.

The decision is limited to Section 42 and does not address other federal or state laws. Whether the plaintiff will appeal is not yet known.

For members, the ruling is a reminder of the value of the public comment process during QAP development. OCAH participates in each QAP comment period and welcomes member input as we prepare our comments.

📢 OHFA Pauses Rural Set-Aside Applications

Due to current funding availability, the Oklahoma Housing Finance Agency has temporarily paused applications for the Rural Set-Aside within the Oklahoma Housing Stability Program’s Increased Housing Program.

OHFA staff will recommend an application for approval at the September 23 Board of Trustees meeting. If approved, the remaining funds will be insufficient to support another application.

Applications are expected to reopen once program repayments restore the Rural Set-Aside’s available funding to $3 million. OHFA will notify the public when applications are being accepted again.

The Housing Stability Program operates as a revolving funding source. As homes are sold and rental developments transition to permanent financing, funds are repaid and reinvested in future housing developments. Under the program’s rules, 75% of funds must support rural communities.
