IT'S AUGUST 18TH AND THE WORLD OF REAL ESTATE IS STILL STANDING! (At least I think)
For the past 12-18 months there has been ample concern and consternation about the future of the real estate business. Yesterday, there were some new rules and reminders of old rules that went into effect nationwide, that were the result of a lawsuit against the National Association of Realtors. However, these rules took effect a few weeks back locally.
A quick summary if you haven't been beaten over the head with this information like I have in the recent past:
1. Buyers must enter in to a contract with an agent before that agent can show them a property. The length of that agreement can be one hour, one day or ten years. But that agreement lays out the fiduciary responsibilities of the buyer's agent and also lays out how the buyer's agent will be compensated for their services. In most cases, this agreement can be canceled by either party with notice to the other.
2. Agents must inform sellers that commissions are negotiable and that compensating a buyer's agent is not required. Contrary to what has been widely reported, this is the way it has always been and it is more of a reminder to sellers that this is the case. As is the case with most things, there are pros and cons to decisions like these.
3. Commissions offered to the buyer's agent from the listing agent can no longer be advertised on the MLS. It was insinuated that real estate agents were steering clients to certain properties and away from others based on the commission that listings were offering. This was NEVER the case for me and I feel confident that it was never the for 99.9% of agents out there.
