Sifting through some data, looking for some answers, and I thought that this was worth sharing.

What's our policy on Security Deposit Returns?

Well, fair and accurate is what we strive for. Owners need to be compensated if there truly was damage, or rents owed at move out, but, at the same time, tenants cannot (and should not) be charged for Normal Wear and Tear Items.

So, this is what 4 years worth of move outs looks like for us:

Of course, if we could return 100% of the deposit 100% of the time, that would be my preference! That means the units were cleaned, no damage, and all of the rent was paid before move out... but 83% getting 100% back is not bad IMO.

A court decision in New York has found that New York requiring landlords to accept Section 8 Vouchers as a source of income unconstitutional on 4th amendment grounds.

Meaning, landlords were forced to participate in the program whether they wanted to or not. And the program required them to undergo certain inspections in order to get paid.

Long story short, those inspections were considered an 'unlawful search' since the landlords had no choice but to comply.

Okay, but what does that have to do with us here in Texas? We ain't New York...

Correct. We are not New York, but there are people here that would love to require landlords to be forced to participate in the program, and this case reinforces property owner rights.

Here in Texas, rental properties are required to have 'Keyless Deadbolts' installed for tenant safety.

No, we're not talking about electronic deadbolts that you can open with a code. We're talking about a deadbolt that can ONLY BE OPENED FROM INSIDE THE HOME.

It's a great idea, and it does protect tenants from unwanted intrusion by someone with an extra key... but the downside can be costly.

If you leave the house like a lot of people, and you exit through the garage, make sure that you leave at least one of the those keyless deadbolts unlocked, because if you come home, and the garage door will not open for some reason, you are literally locked out of the house, and the only way in is to break in.

And yep, you guessed it, that is a tenant responsibility, as well as repairing any break in damage.

If you're in Texas, and your rental property does not have a keyless deadbolt, ask your property manager about it. It's the law!

As Property Managers, we have to ensure that the units we manage meet the Texas Proeperty Code AND we want to minimize the risk for our Property Owner's.

That's why when we see something that's not wuite right, we make sure it gets fixed.

When taking over new units for management, we often see that owner's may have tried to comply with the property code for locing devices, but they install the wrong thing, such as a Hotel Style Deadbolt.

This is why those types of locks just do not work for the Rental in Texas....
