HB 2680: New Rules for Landlords who Require Applicants to Pay Screening Charges
This change to the Residential Landlord and Tenant Act makes changes to the law about screening charges passed along to those who apply for a rental. The three most important are:

After a screening company or credit reporting agency provides their report to the landlord, the landlord must promptly provide the applicant with confirmation of the screening, including a copy of a receipt from the company.
A landlord who requires an applicant screening charge must refund the applicant screening charge within 30 days if the landlord has not conducted or ordered any screening of the applicant before the applicant withdraws the application in writing.
There is a new item on the list of things a landlord must give the applicant notice of before the landlord charges the tenant a screening charge: the landlord must now give the applicant notice of the applicant’s right to: (a) a refund of the screening charge (described in the previous sentence), and (b) recover $250 plus two times the screening charge if (i) the landlord fails to comply with the screening charge laws; or (ii) the landlord does not conduct a screening of the applicant for any reason and fails to refund an applicant screening charge to the applicant within 30 days.
