Dream Teams & Decades of Advocacy: The Fight for US Residency-Based Taxation | The Interchange Podcast

For half a century, dedicated individuals and organizations have tirelessly campaigned to drag antiquated US tax treaties into the 21st century and alleviate the immense burden on American citizens living abroad. In this inspiring excerpt from "The Interchange Podcast with Latife Hayson," Latife applauds the incredible work of these champions. She celebrates Karen Alpert, founder of Fix The Tax Treaty, who has been instrumental in highlighting the unique challenges faced by US citizens in Australia. Latife also recognizes the powerful advocacy of John Richardson and Laura Snyder of SeatNow.org, alongside the long-standing efforts of the AARO - Association of Americans Resident Overseas and American Citizens Abroad(ACA).

These groups have relentlessly lobbied Washington, D.C., to replace the US's archaic citizenship-based taxation (CBT) with the globally standard residency-based taxation (RBT). The discussion then shifts to a bold idea: what if figures like Ken Griffin or Jamie Dimon, with their access to government and brilliant minds in finance, could spearhead a concentrated effort? Imagine leveraging top-tier talent to conduct the deep research needed to propose fundamental changes to tax treaties and legislation, truly freeing US expats from worldwide tax reporting and financial burdens. This "DOGE-like" approach, as Latife describes it, could accelerate the path to a fair and sensible tax system, allowing US citizens abroad to thrive under RBT like everyone else in the world.

A Game Changer for US Expats? Representative Darin LaHood's Proposed Residency-Based Taxation Bill | Latife Hayson

Imagine a world where US citizens living abroad are no longer burdened by the unique complexities of US worldwide taxation. In this highly anticipated excerpt from "The Interchange Podcast with Latife Hayson," Seth Hertz of Expat US Tax delves into the groundbreaking implications of Representative Darin LaHood's proposed Residence-Based Taxation (RBT) bill. Seth explains that this landmark legislation, if passed – a significant "if" given the legislative hurdles – aims to fundamentally shift the US tax system from its current citizenship-based taxation (CBT) model to a more common residency-based taxation (RBT) approach for qualifying Americans abroad.

For millions of US expats, this bill could be a dream come true. Seth discusses how the proposed changes would, among other things, eliminate the need for many burdensome IRS nuisance reporting forms like FinCEN Form 114 (FBAR) and potentially Form 8938 (FATCA), Form 8620 (PFICs) and forms 3520 & 3520-A, significantly reducing compliance costs and stress. Crucially, it would free US citizens from the obligation to file and pay US taxes on their worldwide income and assets, focusing US taxation only on US-sourced income. While acknowledging the long road ahead for such a bill, Seth highlights the immense potential for simplifying the lives of Americans abroad, fostering financial freedom, and encouraging more US citizens to maintain their ties with the country without facing punitive tax burdens. This discussion is essential for all US Citizens living outside of the US, anyone thinking about moving abroad and those interested in the future of US expat taxation, and the ongoing efforts to reform a system that impacts millions of Expat US Citizens emotionally and financially.

Renouncing US Citizenship: Costs, Exit Tax, & "Covered Expatriate" Status Explained | Latife Hayson

Considering severing your ties with US citizenship? It's a significant decision with considerable financial implications beyond just giving up your passport. In this crucial discussion from "The Interchange Podcast with Latife Hayson," Seth Hertz of Expat US Tax breaks down the complex costs and tax considerations involved in renouncing US citizenship. Seth first outlines the initial government fee for relinquishing your passport, which, as of 2025, stands at US$2,350.

The conversation then shifts to the critical concept of being a "covered expatriate," which determines if you'll face a substantial "exit tax." Seth meticulously explains the three tests the IRS applies: (1) your net worth (currently $2 million or more), (2) your average annual net income tax liability for the five years prior to renunciation (exceeding a certain threshold, which is indexed for inflation), and (3) a compliance certification (failure to certify five years of US tax compliance automatically makes you "covered"). If you are deemed a "covered expatriate," we talk about how you could be subject to an exit tax, calculated as if you sold all your worldwide assets the day before renunciation, with unrealized gains potentially being taxed. He emphasizes that navigating these rules is complex and requires careful planning to avoid potentially massive tax liabilities.

The "Savings Clause": Why US Tax Treaties Don't Always Save Expats from US Taxes | Latife Hayson

Many US citizens living abroad mistakenly believe that tax treaties between the US and their country of residence will completely eliminate their US tax obligations. However, as Seth Hertz of Expat US Tax reveals in this crucial segment from "The Interchange Podcast with Latife Hayson," a key provision known as the "Savings Clause" often overrides this expectation. Seth explains that almost all US tax treaties contain this clause, which essentially "saves" or preserves the right of the United States to tax its own citizens (and sometimes residents) as if the treaty didn't even exist.

This means that while a tax treaty might offer benefits to residents of the other treaty country who have US-sourced income, it generally does not relieve US citizens living abroad from their obligation to file US tax returns and pay US taxes on their worldwide income. The US asserts its right to tax its citizens based on citizenship-based taxation, a unique approach globally. Expats still need to rely on domestic US tax provisions like the Foreign Earned Income Exclusion (FEIE) and Foreign Tax Credits (FTCs) to mitigate double taxation, rather than expecting a treaty to exempt them entirely. Seth points out that all the mandatory complex forms that he has described in the full-length version of our interview, all came about because of the ‘Savings Clause’. Understanding the Savings Clause is vital for all US expats to correctly interpret their tax obligations and avoid potentially costly misunderstandings about treaty benefits.

Australian Superannuation & US Tax: A Minefield for US Expats in Australia | The Interchange Podcast with Latife Hayson

For US citizens calling Australia home, navigating the complexities of Australian Superannuation Funds under US tax law is arguably one of the biggest challenges. In this crucial excerpt from "The Interchange Podcast with Latife Hayson," Seth Hertz of Expat US Tax unpacks the IRS's notoriously complex and often punitive treatment of these mandatory retirement savings. Seth highlights that unlike many other foreign pension systems, Australian Super funds don't automatically receive tax-deferred status from the IRS. This often leads to situations where employer contributions, annual earnings within the fund, and even distributions (which might be tax-free in Australia) can be subject to US taxation.

A major concern raised by Seth is the potential for Australian Super funds to be classified as Passive Foreign Investment Companies (PFICs) or Foreign Trusts by the IRS, leading to incredibly burdensome reporting requirements (like Form 8621 or Forms 3520/3520-A) and punitive tax rates. He illustrates how this can result in situations where US expats face significant US tax liabilities on their Super, potentially without being able to offset them with Australian taxes paid, essentially creating double or even ""super"" taxation. Seth emphasizes that the lack of clear IRS guidance and the specific nuances of the US-Australia tax treaty regarding Superannuation make professional advice essential. This segment is a must-listen for anyone with Australian Superannuation trying to understand their US tax obligations and avoid costly missteps.

This comprehensive interview decodes critical issues impacting millions of US citizens living overseas. Seth illuminates the fundamental difference between Citizen-Based Taxation (CBT), which the US uniquely employs, and the global standard of Residency-Based Taxation (RBT), explaining why US citizens are taxed on worldwide income regardless of where they live.

Seth then outlines crucial annual compliance, including the necessity of FBAR (Foreign Bank and Financial Accounts) reporting on FinCEN Form 114, detailing which accounts must be declared and the severe penalties for non-filing. He also breaks down the pervasive Foreign Account Tax Compliance Act (FATCA), explaining how it compels foreign financial institutions globally to report your bank accounts and investments directly to the IRS.

We tackle the notorious complexities of Australian Superannuation Funds for US citizens, revealing how these retirement savings can surprisingly trigger US tax liabilities due to their classification as Passive Foreign Investment Companies (PFICs). Seth clarifies the often-misunderstood "Savings Clause" in US tax treaties, illustrating why it frequently prevents US citizens abroad from escaping worldwide taxation. Finally, we explore the significant decision of renouncing US citizenship, detailing the costs and the critical "covered expatriate" tests that can lead to a substantial "exit tax." Decoding PFICs: The US Expat's Toughest Tax Hurdle & Australian ETF Pitfalls | The Interchange Podcast with Latife Hayson

For US citizens living outside the USA, one of the most complex and potentially punitive tax challenges comes in the form of Passive Foreign Investment Companies (PFICs). In this eye-opening segment from "The Interchange Podcast with Latife Hayson," Seth Hertz of Expat US Tax delves into the intricacies of PFICs and why they are such a significant problem for US expats. Seth explains what constitutes a PFIC, often including seemingly innocuous investments like Australian Exchange Traded Funds (ETFs), managed funds, and even certain unit trusts. He highlights the burdensome Form 8621 reporting requirement, which can be incredibly time-consuming and expensive to prepare annually for each PFIC held. Crucially, Seth illustrates how investing in a standard Australian ETF can lead to disproportionately high US tax liabilities, often at the highest ordinary income rates, with potential interest charges, and without the ability to fully offset these taxes with Australian taxes paid. This creates a scenario of double taxation or, worse, "super-taxation," leaving many unaware expats facing unexpected and substantial tax bills. Learn how to identify these investment landmines and why proactive planning is essential to avoid this costly trap.
