The Conveyancing Process: From OTP to Registration

At InfoProp East Rand, we understand that buying or selling a property can feel overwhelming. That’s why we guide our clients through every step of the conveyancing process to ensure a smooth and stress-free experience.

1. Signing the Offer to Purchase (OTP)

The process starts when the buyer and seller sign the Offer to Purchase (OTP). Once accepted by both parties, the OTP becomes a legally binding agreement.

2. Appointment of the Conveyancer

The seller usually appoints a conveyancing attorney to handle the legal transfer of the property. The conveyancer manages all legal documentation and coordinates the transfer process between all parties involved.

3. F**A and Supporting Documents

Both buyer and seller are required to submit F**A documents, including:

ID documents
Proof of address
Marriage certificates (if applicable)
Company or trust documents (if applicable)

The conveyancer also requests rates figures, levy clearances, and bond cancellation figures if there is an existing bond on the property.

4. Bond Approval

If the buyer requires finance, the bank processes the home loan application. Once approved, bond attorneys are instructed to register the new bond.

5. Signing of Transfer Documents

The conveyancer prepares all transfer documents for signature by both parties. Buyers will also receive statements for transfer costs and transfer duty payable to SARS if applicable.

6. Guarantees and Compliance Certificates

The purchase price is secured through bank guarantees or deposits paid into the conveyancer’s trust account. The seller must also provide the necessary compliance certificates, such as electrical, gas, beetle, or plumbing certificates where applicable.

7. Lodgement at the Deeds Office

Once all documents, guarantees, and clearances are in place, the transfer documents are lodged at the Deeds Office. The documents are examined by several officials before registration is approved.

8. Registration and Payout

On the day of registration:

* The property is officially transferred into the buyer’s name
* The seller’s bond is cancelled (if applicable)
* The buyer’s new bond is registered
* Funds are paid out to the seller
* The buyer receives ownership of the property

This process typically takes between 8–12 weeks, depending on bond approvals, compliance certificates, and Deeds Office timelines.
