Seen "sold voetstoots" in a listing and assumed it means no risk?
Think again.

• Voetstoots means "as it is". You buy the property in its current condition.

• Most SA sales include the clause, so visible defects are generally yours to assess before you sign.

• It does NOT protect a seller who knowingly hides a defect. Problems they were aware of can still come back to them.

• Your real protection is due diligence: a thorough inspection, the electrical and beetle certificates, and a clear read of the Offer to Purchase.

• Check levies, rates clearance and any sectional title conduct rules before you commit.

The takeaway: the clause shifts responsibility to you,the buyer, so inspect properly and ask the right questions before you sign.

Saturday Cape Town History: Adderley Street, 1896 🏛️

Horse-drawn carriages, a busy crowd, and Table Mountain watching over it all.

Yet 1896 was also the year electric trams arrived in Cape Town, running on overhead wires,from Adderley street to Mowbray.

That was five years before London's first electric trams in 1901.

Did you know a Power of Attorney dies with the person who signed it?

The moment a homeowner passes away, that POA is void - no exceptions.

From there, only the executor appointed by the Master of the High Court can manage or sell the property.

That handover isn't instant either. Estate winding-up can take months, sometimes years, and families are often caught off guard by the delay.

A POA covers you while someone's alive and unable to act. It does nothing once they're gone.
