Most landlords in South Africa sign a lease, hand over the keys and hope for the best.
But the Rental Housing Act exists to protect you too. Here’s what you’re legally entitled to as a landlord in South Africa:
✅ 1. The right to a signed lease agreement
You have the right to a written lease that both parties sign before occupation. No verbal agreements. No assumptions.
✅ 2. The right to a security deposit
You can legally collect a deposit typically 1–2 months’ rent and hold it in an interest-bearing account for the duration of the lease.
✅ 3. The right to timely rent payment
Your tenant is legally obligated to pay rent on the agreed date, every month. Late payment is a breach of contract, full stop.
✅ 4. The right to conduct property inspections
You are entitled to inspect your property, on move-in, move-out, and periodically with reasonable notice (usually 24–48 hours).
✅ 5. The right to take legal action
If a tenant breaches the lease, whether it’s non-payment, damage, or illegal activity, you have the right to follow legal process to recover costs or reclaim your property.
