AN ESTATE AGENT'S DUTY REGARDING LATENT DEFECTS IN A PROPERTY: Describing a property as “beautiful” or “stunning” is not regarded a representation that the property is structurally sound. A recent High Court judgement clarified that a property practitioner’s duty is to disclose defects and material information that they know about. An agent is not expected to carry out engineering inspections or investigate hidden structural defects unless there are special circumstances indicating that further enquiry is required.

Is daar 'n reël wat Suid-Afrikaners verhoed om onmiddellik nadat hulle 'n huis gekoop het in te trek?

Die antwoord is ja!

Huur gaan voor koop!
'n Bestaande huurkontrak bly geldig na die verkoop van 'n eiendom. Al die regte en verpligtinge in die bestaande huurkontrak geld. Die huurder verloor nie daardie regte bloot omdat die eiendom van eienaar verwissel nie.
Kopers kan dus nie van huurders verwag om voor die einde van die huurkontrak uit te trek nie, selfs al het die eienaarskap van die eiendom verander. Daarom is dit belangrik om die volgende te vra wanneer jy 'n eiendom koop:
-Word die eiendom tans verhuur?
-Wanneer verstryk die huurkontrak?
-Bestaan daar enige hernuwingsopsies?

Dit sal beslis help om misverstand te voorkom en sinvol te beplan.
