What if the off plan project is not completed or the developers run away? Will I lose my money?

Answer: Whenever an Off Plan project is launched, there is a requirement by law for a third party government agency/trustee to open an ESCROW account, typically in the name of the project launched. This account is referred to as a safekeeping account and is managed by the third party government agency/trustee. All the sales proceeds from investors/buyers go into this account. The developer is not permitted to use any amount excluding finances required for sales, marketing, consultancy, construction and land payments. These required amounts are dictated and released after completion of each phase in the construction.

A MONUMENTAL motivator for Investors..

Dubai have announced the scrapping of their minimum payment structure of any purchase for a property valued over 2m purchase in order to be eligible for their 10 year golden visa.

WHAT? YESSS.. that is correct..

Confused? Ok so before, if you wanted to be eligible for Dubai 10 year residency visa known as the golden visa, you had to purchase a property valued over 2m dirham and a minimum payment for this purchase through a mortgage or payment plan had to be at least 1m. NOW there is NO minimum payment but the property purchased still has to be over 2m dirhams.

This gives developers offering payment plans an incentive to offer lower deposit amounts and also encourages and motivates buyers to break the 2m purchase amount barrier.

How do I know a project in Dubai is legitimate? Before signing an off-plan unit sale and purchase agreement, some key details that you should look into as an obvious starting point:-

1. Is the real estate project, where the unit is located, registered with RERA?

2. Is an Escrow account established for the project. Obtaining the escrow account details will give you peace of mind, as it ensures that your funds will be protected throughout the development process.

3. Determine the stages of completion and the expected date of completion for the project.

4. Is the developer registered with Rera? Does the developer own the development land? If not, is there an agreement between the owner and the developer? This will determine the credibility and reliability of the developer.

Remember, the above points cover and represent if the developer has required all the permits and approvals from the DLD and Rera to sell units off-plan in the relevant project. If this is the case then you can be confident that you are investing in a legitimate project.
