📣 Under Republic Act 6552 (the Maceda Law), a developer's cancellation of a contract to sell real estate on installment must be done through a notarial act.

⁉️If the notice of cancellation is not notarized, the cancellation is generally considered not officially effective or invalid.

📣Here are the key details based on RA 6552 and Supreme Court rulings:

⁉️Mandatory Notarial Act: The law requires the seller to send a "notice of cancellation or demand for rescission of the contract by a notarial act". A simple letter or email is not sufficient.

⁉️Two-Step Process for Cancellation: The cancellation only takes effect 30 days after the buyer receives the notarized notice.

📣Validity of Cancellation: The Supreme Court has ruled that if the notice is not notarized, the cancellation is incomplete, and the contract remains valid and subsisting.

📣Two-Year Rule:
Less than 2 years of payments: The seller must provide a 60-day grace period, followed by the 30-day notice of cancellation via notarial act.
2 or more years of payments: The buyer is entitled to a longer grace period (1 month for every year of installments paid) and 50%–90% refund (cash surrender value). The cancellation, including the 30-day notice via notarial act and payment of cash surrender value, must be completed.
